Filing I-130/getting reciept

Ok,

I was visiting my husband in the states and we were living there, I was going to start my paperwork, but had to go to Canada for a wedding.

When we tried to enter the states again we were denied access. But the border gaurd said that we could file the paperwork for a k3 visa and get a reciept from the 1-130 that would allow us to enter the states while we wait for the rest of the visa to go through.

Anyone know anything about this? I'm going to take the gaurds word for it and try it out once we file this paperwork, but we shall see if it works..

You can file for a spouse visa, either CR1 or K3 but you do not have to wait for the I-130 receipt to file the second petition, I-129F for the K3 visa. Whether filing receipt (Called a Notice of Action) will help you gain US entry will likely depend on where you cross and who you talk to.

I suspect the reason you were turned away has to do with the answer(s) you gave to the CBP officer's questions perhaps combined with the fact you were traveling together. For instance you are authorized to visit the US but not authorized to "live" or "reside" in the US, yet.

For the benefit of our members, would you be kind enough to elaborate on the details of the conversation at the border?
