I've just got done visiting my fiance in the u.s for three months, we decided to get married about 6 months ago now that i have returned we need to start work on filling stuff out for the k-1 visa, the only problem is she does not turn the legal age to marry until feb 1st of next year, we dont want to wait until then to start filling out everything, so is it at all possible to get the process underway now before then in time?

No. If I were you, I would wait until she is of legal age, visit again, gather the requisite evidence and file.

Anything else will raise all kinds of red flags.

Understandable, we have most of the prequisite evidence, photo's and such, we have known eachother almost 2 years and been together for most of that, problem is she is having such a hard time with me not being there, i'm very eager to push things foward as quickly as possible.

any other suggestions are welcome.

Remember AFQuaid? She was 17 when her American fiance petitioned for her visa eventually issued by the London consulate.

I do remember her saying she had a letter in the file from her parents acknowledging the relationship and giving their consent.

AFQuaid was 18 when she entered the US, and the fact that she probably would be was documented by her fiance when the petition was filed.

That being said, we are talking London in that case. Not a high fraud post.

I'm from england myself...

I'm just hoping this could possibly work out...by the time the processing is done she will be old enough and her parents fully acknowledge and give complete consent to it, if anyone has ever done this before or heard of it please step up and help me out.

I presume you are a naturalized citizen now?

What country is your fiancee from?

In this particular case, I believe the underage individual is the US petitioner. If I understand the rules, the petitioner must be of legal age to get this done.

According to his original post his fiancee is the USC while he is a Brit.

That's what I get for speed reading.

You're right. The petitioner has to be of legal age to marry when the petition is filed. Just as they have to be legally free to marry when filing.

Yes my fiance is a us citizen and i'm british, so theres no possible way that the visa application can be filled in before she is legally able to marry ? hmm that isn't good ...I'm really stuck with what to do, we want to get things out of the way as soon as possible, it will be another 6 months before she is legal..may have to look into other things.

But this seems the best way about it.

I don't know about UK law, but if it is possible to legally marry under the normal age with parents consent, then you should be good to file once you have proof of that consent available.

Hmm... now that I think about it - it might be US law, not UK law that prevails - so find out the rules for the specific State you plan to get married in.

If you read page 3, item C on the I-129f petition, you will note that as long as your underage fiancee has written parental consent to marry included with the petition, you are good to go with filing now.
