Is this "normal"?

If you have a look in my signiature you'll see that my I130 was processed at the California Service Center and my I129F is in Vermont.

It seems they sent my I129F to Vermont to join my I130, but then my I130 was sent to California. Is this some sort of weird game of tag? :wacko:

Our I130 was approved on June 19th and today I just received notice that the I129F is pending. Maybe the K3 visa is catching up to the I130? So far we haven't heard from the NVC so maybe the k3 with bypass the I130 in the race.

Any ideas?

Yes it's normal, now all the I-129F forms are processed at California Service Center. Actually now everybody needs to submit it there.

For your I-130 call NVC with your CSC case number and ask for your NVC case number (it's an automated message) so you'll know where you stand

I've got a question, how come you did not file to the consulate? If you are both living in Canada as far as I know that was actually what you should have done...

I've got a question, how come you did not file to the consulate? If you are both living in Canada as far as I know that was actually what you should have done...

We tried. Grrrr... we went to Calgary in January. After standing in line and waiting I tried to present the I130 there and they said they no longer had jurisdiction due to a new law. I recently saw on the USCIS website that consulates are once again able to receive I 130. So, we tried during the short period it wasn't allowed. We had mailed everything off by the time it was reinstated. Quite frustrating.

I'll have to check if I can call the automated message. Any 1-800 number given so far does not work from Canada. The only way I've gotten through is actually calling Homeland Security and a nice receptionist puts me through to an operator. So I will check it out.

Endless, so, do you think my I129F has been transfered from Chicago to Vermont and now California? maybe that would explain the delay.

Sorry, I was just reading the new I129F form and I see the new instructions on how to file. So I am guessing that my I 129F did indeed need to get transfered to CSC to join my I130. It's amazing how fast things change... and I see that there is now no fee for filing the I129F if it's a K3. Wow!

Oh well... we are getting closer. Now I am curious to see which consulate they will send all this. Montreal or Vancouver. We live in Saskatchewan.

I called the Automated number and they have "no record of case number". The I 130 was approved on June 19. The NOA says not to contact them for 90 days so I guess it is still within their timeframes not have it on record yet???

I found this in the FAQ

"The State Department has indicated that in K3/K4 cases, that the USCIS (INS) will retain the approved I-130 petition. This means if he K3/K4 visa holder wishes to obtain an immigrant visa at a Consulate, they need to notify that Consulate to begin the process, after which the Consulate will request the approved I-130 petition from the USCIS (INS). The USCIS (INS) seems to expect that most K3/K4 folks will apply for AOS from inside the United States, but due to long processing times at some local offices, it is very possible some folks will wish to opt for Consular processing after they arrive in the United States. "

Should I contact the Montreal Consulate to begin the process? With my K3 visa pending now I am guessing approval will be soon. I have read on another forum that the K3 visa interview happens a lot sooner than the immigrant visa interview.

Any thoughts?

You haven't been lucky with your DCF... sorry about that. At least you guys are together...

I don't know about the difference in time between IR-1 and K3, it depends on the consulate, check on this forum about that, I'm sure you can find a lot of canadians. In Italy, where my consulate is there seems to be no difference in the waiting time for the interview.

I guess your I-130 following the new guidelines has been retained from USCIS because you filed the I-129F. Honestly I don't know what is best. How to activate the I-130 again and how long this would take. If I were you I would call USCIS and see what they say about it (probably nothing).

Sorry, I hope somebody here in the forum has some experience about asking to "activate" the I-130 again...
