Hi everyone, and thank you SO much for your posts, advice, and encouragement. I faxed James (my fiance) my 1040EZ from last year, along with my W2s, which he will send off by courier tomorrow, along with his passport, a letter explaining the discrepancy in income, and a LOT of prayers.

Basically, my income last year was 21,000 from 3 jobs, but I filed the I-129F in April and had received a raise to $29000 by then so that is the income I put down in that filing. Now I am making $40,000, so all three amounts are different. I explained that in the letter, I just hope they understand, accept it, and (Please Please Please) grant us the visa.

Does anyone know how long it takes for them to reach a decision on something like this, or how soon we can ask them for the status of the case?

Thanks again!

Tracy

well tracy

i would recommend to you reading my reply a little better. I said that it will cause about A 2 WEEK DELAY on their part. That is after they recieve the passport and the tax returns from your fiance. At least that is how long it took in my case. But I went through the same thing, so feel free to IM if this does not explain it to you. hahah for real, feel free to send a private message

tracy,

Did you provide supporting documentation for the $40,000 - letter from employer and recent pay statements - and a new I-129f showing your current income?

Might be helpful if you did, shouldn't be fatal if you did not.

Yes, I included all this (and more!) in the packet that my fiance took to the interview: copies of all my paystubs, a letter from my employer stating my employment status, my job offer letter from the company, and all my employee benefit information (ie he is my beneficiary for my $200,000 life insurance, so if something happens to me he is covered.) And Of course, I included an I-134 showing my new income. But they wanted the tax return as well I guess...

I hope that will be all they want! We will of course be sleepless and worried until we know for sure.

We sent everything off yesterday morning by courier- my tax returns and W2s from last year along with my fiance's passport- so now we will wait until we hear from the embassy again. James (my fiance) called the embassy yesterday and they indicated that we should hear something in about 3 weeks, so I will update this thread when we hear what their decision is. In the meantime we will keep planning the wedding and hope everything will work out!

hi tracy,

this exact thing has happened to me and my hubby. at the interview they w/held the visa until they received my 2006 taxes. i hadn't filed 2006 taxes, because i was living and working in the UK & made about $4000. so, last week i backfiled (really easy) at the local IRS office stating my foreign income (2555 form). this has been sent to the embassy but I also had my mom co-sponsor (at the last minute). the courier picked up this paper work and my hubbys passport last tuesday.

i have been calling the dept of state to check and see if they have begun processing it and they don't even show it has been received. all the lady could tell me was that sometimes it takes a while for paperwork to make its way around the embassy! i'm pretty p/o about the slow state of the courier getting packages delivered. i just imagine it sitting somewhere waiting in a big pile! this past month has showed me that they were pretty quick processing paperwork (4 days) but from the courier to my husbands hands it took almost 3 weeks!

so i'm pretty anxious about the wait ahead.

from what i heard (read) they should process it quickly. but it's the time inbetween the embassy and the couriers that bothers me. too long!

just sending in your paperwork should be fine! i'm telling myself the same thing!

just waiting is the worst part.

i think you'll get it done definitely soon.

good luck!

This happened to me exactly

I did not make enough the prior 4 years

But now I am making enough

In the original petition I sent a letter from my employer stating how much I am making now, when I started, and that my position is full time and my last 3 paystubs

They asked for my last 3 years of tax returns, all of which showed I did not make sufficient income. They just wanted to see that I paid taxes at least. Anyway, send the tax returns, it doesnt matter what you made, then also a letter from the employer and the last few paychecks to show them. All will be fine, maybe a 2 week delay at most on their side. Depending how fast you get your stuff.

This is no problem at all. Or at least in my case it was not. And my K1 interview was 3 months ago

Raspect...what exactly do i need for the interview?...mine is in two weeks in Lima. My Scott is not coming, so i feel nervous...

you need the IRS form 1040 for the last year or two, with supporting evedence such as scheduals or w2 forms

see this is something I am losing sleep, hair, weight and sanity over. Nick has NEVER filed taxes as he's never made enough and as he is currently here in UK with me is not working. We are using a co-sponsor for my K1. Nick is going back to NE 6th december and getting work (anything he can find) to show willingness to work but he has no tax returns for me to produce. Up until 2005 he was listed as a dependant on his parents. I've no idea what I can produce as proof and it's causing so much stress.

Yep to what Trailmix said. Also, here's a good link in another forum about what to cite in the statement saying you didn't have to file a tax return -
