Does anyone know how to get dual citizenship for

Hi all,

I tried e-mailing the Mexican Embassy but alas, they did not answer me.

I am the USC and my Mexican husband now has his green card. We had a baby last December and I want him to have citizenship in both countries. Anyone know how we go about procuring his Mexican Citizenship?

April 26 thru 29 Tried to make biometrics and fingerprinting appointment to no avail.

April 29, 2005 Just walked in and had them done.

May 18, 2005 Received RFE for Supplemental Form to I-693 dated May 13.

May 31, 2005 Sent in Supplemental Form to I-693 as requested.

June 7, 2005 Received e-mail notice stating Supplemental Form to I-693 had been received.

June 16, 2005 AP & EAD approved!!!

August 5, 2005 Received appointment letter for AOS interview: October 20, 2005

October 20, 2005 AOS Interview APPROVED!

uhmm

my guess would be to apply with embassy in mexico - the same place where you would get

say a Visa from them. apply for immigration benifits. thats just my guess.

I thought dual citizenship is a birth right of your child.

meaning he does have dual citizenship because of you

and your husband.

I think you're going to have to keep picking through the Mexican Consulate's info on how to register the baby's Mexican citz. Keep hunting.. I have a feeling it's been done before. :)

Declaratorias de Nacionalidad Mexicana por Nacimiento

Es el documento oficial que expide la Secretaria de Relaciones Exteriores por conducto de la Dirección General de Asuntos Juridicos, las Representaciones Consulares de México en el Extranjero y las Delegaciones Foráneas.

En dicho documento se hace cnstar que el interesado, se acogió al beneficio de lo dispuesto en el articulo 37, apartado A) de la Constitución Política de los Estados Unidos Mexicanos, una vez que se ha verificado que adquirió voluntariamente una nacionalidad extranjera antes del 20 de marzo de 1988 y que tiene derecho a la nacionalidad mexicana por nacimiento, por haber nacido en territorio nacional o, por haber nacido en el extranjero y ser hijo de padres mexicanos, en términos de lo dispuesto por el articulo 30, apartado A), fracciones I y II de la Constitución Política de los Estados Unidos Mexicanos.

El interesado en obtener la Declaratoria de Nacionalidad Mexicana por Nacimiento deberá cumplir los siguientes requisitos:

Ser mayor de edad y en uso de sus derechos civiles y políticos;

Llenar la solicitud correspondiente, cuyo formato puede conseguir de manera gratuita en las oficinas consulares;

Entregar copia certificada del acta de nacimiento, por la Oficina del Registro Civil que corresponda, resgistrado durante el primer año de edad, o en su caso, por el Cónsul mexicano del lugar en el que se realizó el registro; o apostillada por la autoridad correspondiente, en su caso, traducida al idioma español por perito traductor autorizado

Si el interesado nacio en el extranjero, para probar su derecho a la transmisión de la nacionalidad mexicana, deberá presentar copia certificada por la Oficina de Registro Civil que corresponda al acta de nacimiento del padre o madre mexicanos, registrados durante el primer año de edad, o copia cotejada con su original por el funcionario competente del Certificado o Declaratoria de Nacionalidad Mexicana por Nacimiento.

Cuando el registro del nacimiento del interesado o de los padres sea extemporáneo (después del primer año de edad) el interesado deberá presentar alguno de los siguientes documentos:

Cotejo notarial de la partida religiosa, si dicho acto se realizó durante el primer año de edad y si ocurrió en territorio nacional;

Copia certificada del acta de matrimonio de los padres expedida por la Oficina del Registro Civil, si estos se casaron en territorio nacional y antes del nacimiento del solicitante;

Copia certificada del acta de nacimiento de un hermano mayor expedida por la Oficina del Registro Civil, si nació en territorio nacional y fue registrado dnetro del primer año de edad;

Copia certificada del acta de nacimiento del padre o madre mexicano expedida por la Oficina del Registro Civil, registrado dentro del primer año de edad, ó

Constancia expedida por la autoridad migratoria, de la fecha de internación al país del padre o de la madre extranjeros, si esto ocurrió antes de la fecha de nacimiento del interesado.

Entregar copia certificada del documento que acredite que obtuvo voluntariamente otra nacionalidad, antes del 20 de marzo de 1998, debidamente apostillado o legalizado según sea el caso. De no ser posible obtener la copia certificada de dicho documento, el titular de la oficina deberá hacer un cotejo con el original y asentar los motivos por los cuales no es posible que el interesado obtenga una copia certificada para que obre en su expediente;

Acreditar su identidad con documento oficial con fotografìa y firma, ya sea mexicana o extranjero, del que deberá obrar una copia cotejada con su original en el expediente correspondiente. Se pueden exhibir cualquiera de los siguientes documentos, siempre y cuando cumplan las características antes citadas:

Pasaporte;

Matricula Consular;

Credencial de Instituciones Públicas;

Credencial para votar;

Credencial escolar expedida por institución oficialmente reconocida;

Cartilla del Servicio Militar Nacional;

Cédula de identidad ciudadana;

Cédula, título o diploma profesional, otorgados por instituciones con reconocimiento oficial, y/o

Cualquier otro documento que contenga fotografía y que a juicio y responsabilidad del funcionario acredite la identidad del solicitante.

Presentar dos fotografías a color, tamaño pasaporte (4.5 x 3.5 cm), con fondo blanco, de frente, sin anteojos, cabeza descubierta, tomada con una anterioridad no mayor a 30 días, y

Acreditar el pago de derechos correspondiente, en términos de los dispuesto por la Ley Federal de Derechos vigente en el momento de la expedición de la Declaratoria de Nacionalidad Mexicana por Nacimiento.

OK, the weird thing is that I ALWAYS call my baby my little munchkin and thought I had in my post until I went back and read that I hadn't. Too funny! :P
