Can I enter the USA with extension letter if the I751 is denied?

I applied for I751 last year. In December I got a letter which extends my green card for 1 year - travel and work. So this means it is good till January 2008. However I haven't get anything else yet. I am worried that they might call us for an interview/deny it since my husband and I have a small problem in our paperwork. I plan to go to my home country for a month in September. What will happen if while I am gone they deny our case? Can I still get into the country with the extension letter? Has anyone heard of a story like this? My husband believes that I will not have any problem even if they deny it since I have the extension letter but to me it seems a serious problem and I am very afraid to go. Thank you! Heartbeat

If they call you for an interview, you gotta get it postponed until after you return. If they're looking to deny your case, I think they fist issue a letter of their intent to deny the application. Not sure but I think that's how that happens. In which case yo'd still have time t make it back to make your case.

All that of course depends on what exactly you think is a "small problem" in your paperwork...

It seems improbable that they would deny your application while you are away, but if they do, your extension letter alone probably won't help you to get smoothly into the country. When I entered the US with my NOA, the immigration officer sent me to the passport office, to let another officer check my case in their computer system. What would happen if the second officer found there the decision to deny? I don't know, you still might have a time to appeal.

Appealing from outside USA would be impossible. If the I-751 is denied, while you are abroad, you have no status and you will not be able to return.

07/06/09 - NOA date (rec'd - 07/10) #WAC 09xxx3, touched.

07/08/09 - check cashed, #WAC 09xxx2 (not online)

08/29/09 - APPROVED!!!

NVC

09/14/09 - NVC case # assigned, emails registered

09/17/09 - email AOS bill received and paid online, ds3032 received and returned

09/21/09 - AOS bill status "PAID", FedExed out AOS, 09/24/09 delivered to NVC

09/28/09 - AVR:AOS acknowledged

10/02/09 - 3032 was acknol. by NVC, paid IV Bill online

10/05/09 - emails: 1 pm -RFE for 3032, 3 pm - IV bill, 5 pm - status PAID

10/09/09 - ds230 delivered to NVC at 9am

10/14/09 - AVR: Checklist response was received

10/20/09 - login failed! - between 5 pm and 9 pm PST, at 5 pm it was still working

10/21/09 - case complete! (AVR updated after 10 pm) = total NVC 37 days

10/28/09 - interview date email came at 6.30 pm, no AVR changes yet

10/30/09 - AVR: "Case sent to embassy on Oct 29" = total 4 months from delivery of i130 to USCIS

11/02/09 - Medical

11/20/09 - Interview - PASSED!!!

11/28 - POE: LAX

I was travelling with my wife and children (and NOA, GC, and passport), and they checked my case in the computer system anyhow.

I and my family just came back New York on 08/05/2007 from China with my expired GC and a temporary I-551 stamp on the my passport. I didn't even receive my NOA yet before I left New York for China last month. Re-entry at JFK airport was quite easy even without any question asked. The immigration officer only took my expired GC, which had expired more than two years ago, on 06/13/200, and checkd his compuetr for few minutes

06/17/2003 Conditional Residency Granted In New York City

06/17/2005 Conditional Residency Expired.

04/26/2007 File I-751 Joint Petition To VSC ( Almost 2Yrs After My Conditional GC Expired)

06/05/2007 Package was returned by VSC due to the mistakenly printed amount on the check.

06/06/2007 Resubmitted the new check with the package.

06/25/2007 Check Finally Cashed.

07/05/2007 InfoPass Appointment Scheduled For A I-551 Stamp on my passport.

07/16/2007 The Big Day To me, Got a temporary I-551 stamp valid until 07/15/2008 from new york city local office along with the copy of the cleared check, copy of filed joint petition, receipt of the InfoPass Appointment,

expired Green Card & valid Passport.

07/17/2007 Left New York For China with my family

07/17/2007 Received NOA of I-751 Dated on 07/05/2007

07/19/2007 Received BioMetrics Appointment Notice Dated on 07/16/2007,

finger prints scheduled on 08/01/2007

08/05/2007 Return Back To U.S.A at JFK International airport without any problem along with my expired GC,

Temporary I-551 Stamp with my passport, btw the immigration officer was very nice and professional.

08/07/2007 Biometrics Appointment Make-up. Staffs in Jackson Height Service Center are good. No further questions were asked even though I was late a couple of days for it. I waited about 20 minutes and entire procedure was only taken about 7-8 minutes.

The case is finally touched and I'm done for a while.

08/07/2007 Registered USCIS online case status notification via email program and wait for the good news from 'em soon.

On 01/09/2008, Updated Status: Card production ordered.

Well, I suppose one could try, but having just lost status, with a denied I-751 during a visit overseas, one would have to overcome the presumption that the entry was with immigrant intent.

I wouldn't necessarily equate your experience with all, and intimate that it could be an uneventful re-entry.

By the way, kenwang, care to explain the green card "expired" notation in your timeline? And while you're at it, perhaps the two year delay in filing to remove conditions? Were you involved in a protracted divorce or something? How did you manage to evade removal during those 24 months? "Enquiring minds want to know" ;)
