Hi endless,

it is in the instructions for I-864.

You can order transcripts by calling IRS. It takes about 3 weeks, but I heard you can also ask to fax them, then it is much quicker.

Tax transcripts will substitute for copies of tax forms and W2s.

You can send copies of your tax returns along with copies of the W2s. That's what I used.

Or you can contact the IRS and have them send you the IRS transcripts. Those took about 5 weeks for me and that's why I ended up sending copies of the other stuff instead.

You can send copies of your tax returns along with copies of the W2s. That's what I used.

For 2006, I photocopied my return AND the W-2 forms (and 1099s).

For 2004 and 2005, I submitted tax return transcripts from the IRS. I had requested those as soon as I got the USCIS approval email notice. It took about 3 weeks for me via snail mail to receive them.

It does state to photocopy the return and W-2s but it was kinda subtle sounding on the instructions.

I just got off the phone an hour ago with the NVC, and to my surprise was told that along with the transcripts (not returns) I needed to send in not only the W-2'a and 1099's, but also a copy of tax schedules filed with the 1040 (C, A, et al). I'm wondering if the lady I spoke with was confusing transcripts with returns.

Form 1040 tax transcripts include all the schedules. They don't include the W-2's though. I still think including a copy of the W-2's with transcripts is a good idea because they can't confirm how long you've been with a current employer from the transcript alone, nor how many employers you had. In my case, it is a joint tax return also, so they don't know how much of the wages is attributable to the petitioner-sponsor vs. spouse from the tax transcript alone. All they can see is the total in the WAGES line.

All good reasons to include a copy of the W-2's even with transcripts.

I'm getting my I-864ez packet together I was thinking of attaching a copy of my federal return along w/the W2. However, on my return I filed MFJ and in the SS# field for spouse I entered "ITIN Applied For". We recv'd the actual # via rep @ IRS but nothing in the mail. Will that be enough? I tried requesting the actual docs to verify the ITIN but never recv'd anything. I was able to go online to the IRS website and print off the status page which states both my ss# and his ITIN. Should that ok? I also sending the following w/my packet.

I think the name & address and filing status is more important than the SS#'s. The tax returns just need to appear to relate to you, the petitioner & sponsor. Furthermore, unless the intending immigrant is signing I-864A (allowed in only limited circumstances, and can't be done with I-864EZ), I don't think they care about what his ITIN number is or his income (if any) shown on the tax return. You can tell them what his ITIN is in the cover letter if you want to, but that's about all I'd do about it. Also, I would not alter the tax return copies in any way, even just to give the ITIN number subsequently assigned. Finally, an ITIN is not an SSN, and I would not give the ITIN as a substitute for his SSN on the I-864 form (Instead, I'd enter 'none' for his SSN on the form).
