Marijuana...why did you say that?!?!?!?!?

Timeline

My fiance hadhis medical examination this morning. Everything went well for the most part. He was supposed to fly to Barbados last night, however, the airline, for whatever reason decided to not go to Barbados, but to Trinidad, with no warning or explaination.

He had to fly out this morning to Barbados and go straight to the doctor's office. Unable to change clothing etc.

As stated, the medical went well, from what he told me. He had a urinalysis. But then he stated the physician had him take another one as well.

I said why. He asked if I've ever smoked marijuana and I didn't want to lie. I told him when I was 15.

WHY THE HELL WOULD YOU SAY THAT!?!?!?!?!? THAT'S WHY THEY MADE YOU TAKE ANOTHER TEST!!!!!

I'M SO FREAKING MAD.

He hasn't used marijuana in years. My point is, why would you say that. He doesn't realize they put remarks like that in your record.

His urinalysis I'm 100% sure is negative, put his remark, has left a stain in my mind, so God know what the physicians were thinking. To make it worst, my fiance has dredlocks. Not everyone in the Caribbean likes dredlocks or what they might represent (i.e. smoking marijuana)...yeah

I'm furious! :angry:

11/3/09-Fed-Ex'd package to Vermont

11/5/09-VSC rec'd package

11/10/09-Received NOA1 with 1 year extended conditional residency

11/18/09-Received Biometrics appts for Dec. 10th (Dated 11/17/09)

2/11/10-Green Card Approved!

2/19/10-Green Card received! Glad that's over....next up Citizenship.

I am not sure what they write down during the medical exam or if the doctor will put a remark in about ordering a second test.Maybe only the result will be reflected in the exam!? I don't know, but you have to honor, at least your fiance was honest...lol

Should I not worry?

Personally, I think your fiance did exactly what he should have done - honesty! So let them take another urinalysis, if you are 100% sure it will be negative, what harm will it be. I really think in this whole immigration process that honesty is the best policy. And besides, the doctor is not naive...I'm sure there have been a lot of people going for their medical that has tried marijauna at some stage in their life...and was honest about it.

Take a deep breath and try to focus on the near future of getting to be with your loved one. (Although I know sometimes that is difficult). If he has been clean, there should be no worries.

01-29-07 - Found out from USCIS that my lawyer had filed at the wrong service center and nothing has been processed.

02-08-07 - Found out that our petition had been closed back in Oct. 2006. No one was ever notified of this from USCIS

02-09-07 - Began gathering paperwork once again to start all over. Started cancelling our wedding plans

02-20-07 - Filed for a K-1 visa once again

04-21-07 - Originally planned wedding date (had to cancel) :(

06-01-07 - Granted a Congressional Inquiry!

06-15-07 - NVC received our approved I-129F petition (I never received an NOA2 via email or snail mail). We are just so HAPPY to finally move on!

06-25-07 - Packet 3 received (but it was rec'd by our lawyer, she has forwarded it on to my fiance in Australia)

06-28-07 - Fiance rec'd Packet 3

06-30-07 - Finally rec'd NOA2 via snail mail. It is dated June 25, same day as Packet 3 was rec'd.

07-05-07 - Mailed back form letter DSL-1076 (Applicant's Statement of Readiness to be Interviewed).

07-05-07 - Just waiting now in hopes of an interview date before APEC

07-13-07 - Received Packet 4

07-30-07 - Interview!!!! - APPROVED!

09-01-07 - Fiance arrives in the USA!

10-06-07 - Getting Married

Unfortunately, I know several people who have been denied a family-based visa for admitting to having smoked pot.

If they have admitted to smoking WITHIN the last three years, they will be denied and banned for three years from applying for a visa. If the person says that they smoked a couple of times, even years ago, they are considered a "drug addict." Three year ban.

There is a clause for ONE TIME experimentation that will supposedly not result in a denial.

One friend's husband was denied because he admitted to smoking over ten years ago, and then their explanation when she spoke with an IO was the his bloodwork showed up positive for use of marijuana in the past three years. despite this being a medical impossibility his visa was denied.

One would think that what Kez said would hold true, but unfortunately not when it comes to medicals for visas to the US.

I hate to say this, but yes, you should be worried. I truly hope that everything works out.

If it comes to Immigration I strongly advise to always stick with the truth. Now there are things you should only say when asked for and not volunteer to share, but that's entirely different than lying about something.

Well, I almost always agree with telling the truth to immigration, is it a good idea to do so if it'll surely result in a visa denial?

Do you drink alcohol? and Do you or have you used drugs? are typical medical exam questions (at least in Mexico), and an affirmative answer to the latter will result in a denial, based on the conditions I mentioned above. And they DO profile, at least in Mexico. Men with tattoos and piercings are sometimes much more closely scrutinized and drilled with these questions.

That's a typical question they ask for any government job...they want to know at anytime during your life if you have done drugs. My mom admitted to me to trying "pot" but...she didn't like it..and isn't a smoker. (I was still gobsmacked at that...hehe) But still..even in my application I just filled out...it asked that..and I didn't lie...Yes, I've tried it...but haven't touched the stuff since 1995. (I'm a USC) ..I know Pete has...It doesn't bother me. What would bother me is if my fiance would still be on drugs and lying about it.

You shouldn't be so hard on him for telling the truth tho. :no:

And that's the bottom line here. Each person has to make their own decision on how to answer questions because it's their own case and their own life. It's true that Mexico is a difficult consulate when it comes to these issues. But no one here should be advising people to lie straight up as Reza posted "in some type of circumstance. you don't need to say the true"

This is a clear violation of TOS and a potentially very very harmful piece of advice. I recognize that there are obviously serious language issues here but bottom line -- you cannot tell people it's ok to lie or "not say the truth". Reza, you need to take nane1104's advice and be much much more careful about what you post here.
