On the I-864 poverty guidelines it has a list of 'Means Tested Public Benefits'

I always thought this meant that the non immigrant spouse could not receive any of these benefits when going to live in the US but does it also mean that the petitioner cannot receive any of these benefits either.

I was thinking of applying for childcare benefits, since it is so expensive in North Carolina, and I will be the sole breadwinner until hubby gets his visa.

True, they wont penalize the US Citizen for using services that they are entitled to. The resident alien is not using those benefits.

Though a person who is that close to needing to use those benefits, may be close to the poverty line them selves and may have to rely on a co-sponsor.
