confused topic..

Timeline

hello all,

as you can see from my time lline that I have chosen K3 route and my wife has interview on august 23. Now Ijust received something fuzzy in the mailbox from NVC. It says that we have recieved from immi. visa pettion you filed on behalf of "my wife name". before we process you must send if AOS fee bill. of 70 dollars. why am I getting this.? I have NOT filed I-824 to transfer my I-130 to NVC. the packet also contains ds-3032.

what should I do? (ofcoucrse I will call NVC first thing morning tomorrow)

keeping in mind that, I would like to persue CR1 if possible, even if it means waiting for 3-4 months more.

just to add, for this, I also got a different case number than my K3 case number.

can I persue Cr-1 visa at this point?

when my wife gets approved for K3 can she just wait until this CR1 kicks in (if possible.)..??

9/26/2007 -- NOA 1s for 485 & EAD

10/1/2007 -- biometrics appt letter received

10/13/2007 -- fingerprinting....speed it up guys..

11/28/2007 -- card production ordered - EAD

03/04/2008 -- final interview for greeen card :)

Evidently your I-130 got forwarded. Unless you want it to continue, simply do nothing.

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

They don't have time to clear it through NVC before the interview but they still have the choice of going ahead with it, returning to the home country and interviewing for an immigrant visa instead of adjusting status.

thanks for the clear explanation. Now I have one more to ask :wacko:

lets say my wife comes here and we decide to go back home for CR-1 interview. what can she do here for those 4-5 months while she is waitning in US for the CR-1 interview? I m assuming she will not able to apply for SSN (since no AOS)? do I have the correct understanding? pls help

People who enter on a K3 visa can either adjust status while in the US or go home for a CR1 interview and return on the new visa to obtain their green card.

To soni - I think that K3 visa holders can apply for employment authorisation and then apply for a SSN. Perhaps it says in the K3 guide. You might find that's not worth it though as employment authorisation takes about three months and would be granted with the green card anyway. If she can find it though, she can do volunteer work (truly volunteer, not just an unpaid position that would usually be paid).

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

It's not over with the visa. Depending on proximity to the home country and/or travel plans, going back to interview for an immigrant visa can be very attractive for some, compared to adjusting status. That $1010 saved can pay a lot of travel expenses.

thanks everyone for providing detail and helpfull ideas. at this point, I have just decided to do AOS here once my wife gets herer on K3. Tickets to fly to india are atleast $1200 minimum..so..and I beleive if I start CR-1 process now, it will atleast take minimum of 5 months..so thats it..!!!

With ticket prices like that, it sounds like you've made the right decision. It also means no more separation during the process. :)
