Why did I get an Affadavit of Fee Bill (I-864) when I am going for the K-3?

Hello friends!!!

Why am I getting the Affadavit of Fee Bill (I-864) of $70? Am I supposed to send that in for the K-3? I am confused. Yodrak, if you are here please help me! :crying: Or, anybody who knows about that. Thank you!

Now, here's what is on my mind. I initially got the impression that for the K1/K3 visa, you need to file the I-324 Affadavit of Support. Please, oh please help me! :crying:

I filed for K-3 also and was sent the same fee bill for the I -864, and that was after my wife already had her interview appointment. I believe it is sent because your I-130 was approved. I disregarded the bill. Hope that helps.

Yes, the IV fee bill (I-864) is for the CR/IR visa (I-130 approved) and is a much better visa than K-3. You should go for that visa and you don't have to worry about adjusting status in the US (for K-3). Good Luck!

I forgot to notice the small form to send in with payment. It says VISA TYPE: CR1. ROFL!!!

I got that bill yesterday too. I know CR1 was much better but, it was taking too long for my I-130 approval (298 days!!) I filed for K3 (now I regret I should have file earlier.... and she would be here long time ago, and I didn't have to pay over thousand dollars for Adjustment of Status [starting from July 30]... any way My case went to consulate July 10 and they still didn't respond to my email yet. Hey Consolemaster, what's going on with your k3? did your spouse got interview date yet?? in my country it takes only a few days to schedule the interview... and yet I have no responses from them [ oh yes!!! I am now impatient!!!! can't help ....] I wish I could go to see my wife like you....but my job won't allow me .... wishing you good time... hope you will come back with your wife...

NVC is processing your IR-1/CR-1 even though you k3 might be in your wife's country. The same thing happened to us, my wife received the Choice of Agent Form and I got the AOF fee bill. So I called NVC and they said that yes they are process the IR-1/CR-1 and you have to send a letter informing them to hold the I-130 till you file for adjustment of status.

Call NVC ASAP….don’t pay it yet!

How do you assure that they process BOTH I-12F and the I-130? Then I'd like to have them hold the slower track. Correct?

How did you guys do it?

Why can't you let them process the I-130 in case the interview gets blue-slipped?

the best thing to do is call NVC, find out whats going on.

if you are going to call, call EARLY...like 8am and then again around 12-1PM...it always works for me.

No. CR1 takes a longer time to process than the K-3. It's not good. You cannot foresee the future of what may happen to your SO far away. He/She may suffer from rape, robbery, accidents, etc...It's best to have your SO arrive here in the US as possible so you can easily stay by his/her side when it's needed. That is my thought on this.

I got it too !! Let your spouse to enter in USA on K-3 then let NVC know to send your I-130 to your local office for adjustment of status.

It all depends on what embassy you are going through. Some embassies process K3 & CR1/IR1 visas with only a 1 month difference between the two. It's a personal choice though. Wait a little more or pay the new AOS fee.

Hello Everybody,

Samething happened to me as well. I'm willing to go for K3 for now.

I129F&I130 was approved at the same time.

I received the letter from NVC about 2 week ago giving me the case number and telling me that the file would be sent to the consular in a week or so.. Since then I've been waiting. But, I found out that the consular did not get the file yet! So, I called NVC but I was told that my file is still being processed!! This was suprise to me and I could not get it. The letter I have is saying that my file is being sent but NVC is telling me that is still being processed. Does anybody have this type of exprience? or what do you think is happening?

In mean time I received another letter from NVC regarding I130. They are asking me to pay the $70.00 fee for the I-864.

Do you think this is normal for NVC to send a letter and keep processing the file for some reason? Would they send me another letter saying that the file is being sent now? People at NVC not saying much except " all I se is your file is being processed" . I sent them a couple of e-mails yesterday but, no answer yet.

I'm in dark and dont know what to do! Any ideas? Thanks.

Ok, it's a bit confusing. You received the NOA2 for I-130, and it went to NVC. NVC processes the I-130, you have to pay the 70$ fee + 380$ fee + send all docs (I-864, D23032 and DS230) than it goes your embassy. The 129F just makes a pitstop at NVC get a case number and goes to the embassy. Which kind of approval did you get? If you go for K3 (I-129F) you will have to pay the fee later and show the embassy all the docs. They do the job that NVC does.

From your post it seems that your received both NOA2, so the I130 is still at NVC for processing while the I-129F will only stop there for probably a shorter time.

NVC will process both petition unless you write them a letter stating that you would like them to hold the I-130 because you are going the K3 path. Which from July 30th cost more than 1000$ in fees for adjustment of status.
