HEY EVERYONE---

OUR K-3 PETITION WAS APPROVED ON 2/28/06. THE NVC STILL DOESNT HAVE OUR CASE YET.

OUR I-130 WAS APPROVED ON 3/30/2006.

how this is possible, i dont know; since the processing time for CSC for I-130 says they are still at september 16, 2006. (the receipt date on our I-130 is Jan 6, 2006)

WHICH ROUTE SHOULD I TAKE..?

SINCE THE NVC STILL DOESNT HAVE THE CASE # FOR THE K3 PETITION, IS THERE A CHANCE.. A MERELY SMALL CHANCE THAT THE I-130 WILL BE ISSUED A CASE # BEFORE THE K3 PETITION? and eventually get done faster than the K3?

As far as I know, K3 moves faster than the IR. The furor about IR petition getting to the embassy first was in the early months of 2005, when the IR timelines were moving fast (reason unknown). Since late last year, it seems that IR timeline has slowed down again.

If I were you, I would go for K3. Then play it by ear from there. Don't forget, after "case complete" phase of the IR petition at NVC, when all seem to be almost done, there is a wait (varies from 2-6 months, depending on the country) before you get an interview schedule.

the K3 stays at NVC for only a few days while the CR1/IR1 is being processed mainly at NVC so plan in a few months there.

If both are approved already though, you might consider going the CR1/IR1 route just cuz it'll give you a green card after entry while K3 has to adjust status.

thanks cygnet for bringing up this question..

heres the issue..

the approval for the k3 was done on 2.28.6 and the NVC hasnt gotten it yet... they keep saying to allow upto 90 days.

the i-130 was approved on 3.30.6, and i just saw that it was touched on 4.1.6 which is a saturday. didnt realize gvt institutions were open on saturday,

I understand that the NBC sends stuff in bulk to the NVC.. but still its been over 30 days... for them to assign a case #to the k3.

if the k3 will bring him here faster AND he can go back to get the immigrant visa GREAT!!

1. i will fill out and get the i-864 notarized. can we use 2005 taxes?

2. ds 3032-- my husband is going to be the person resposnible.. so can this get a self generated barcode?

do i pay the nvc (send some fee) for this to NVC as well?

3. ds 230-he can print that out there himself and get it filled out.

4. what is the 380 dollars for?

5. anyway i can send this to them all at once? just in a little effort to speed things up?

Hopefully, others will post more replies as I don't know the answers to all your questions. I don't know much about the K3. My husband doesn't think we can pursue our K3 application as our I-130 has already been approved.

I think NVC is sometimes a little slow on certain things. I asked them last week if they got the fee I sent the week before, and they said that once they get it in the mail, it takes between 7 to 10 days for it to show up in the system.

In the next couple of weeks, try to see what happens to both your applications. I guess you could just see which one reaches the consulate first. The IR1/CR1 would be preferable, of course.

As for your other questions:

1) I think if you've filed your 2005, then you should include it. If you need tax transcripts, now would be a good time to get them from the IRS.

2) DS-3032: I don't know about self-generated barcodes but I received the DS-3032 the day after my husband (the USC) got the Affidavit of Support Bill (along with a copy of the DS-3032) in the mail. If your husband doesn't get his copy in the mail, you can fax him your copy which he can then sign and send.

3) DS-230: We're not there yet, but I've made a copy for myself and "practiced" filling it out. This way, when I get the form with the barcode, I wouldn't have to run around trying to find dates I visited in the US, or places I've lived in for over 6 months since the age of 16, or employment history and so on. :)

4) $ 380 = Immigrant Visa Fee/Bill which he (the agent) has to pay. I had to get mine in the form of a money order in US funds, drawn on a U.S. bank. He can get that at most banks.

My husband, of course, had to pay an AOS bill before he got the I-864 package.

5) They discourage you from sending all the stuff at the same time. In fact, if you look at the NVC flowchart (somewhere in the site, maybe under Guides?), you'll see that one step leads to another. It's not possible to send everything at the same time. You have to wait for their instructions.

lets see how long it will take for the IR petition to reach the nvc. both are getting there from different service centers.

do u think its funny that CSC says they are only processing cases with a date of 9/16/05 and ours has adate of jan 6, 2006......and it s been approved??

i hope they dont make up for the time they saved by taking a longer time to reach the nvc!

Actually, we mailed our I-130 last September 2005. The petition was approved only in February 2006.

I think you were looking at my I-129F which we filed only in January 2006. That one has not been approved yet (and we don't think it will be doing us any good at this point).

The timeline thing on the left isn't working for me today. I'll have to figure out how to put it up on display again some other time.

Your case is pretty UNIQUE because you got your approval rather quickly. But I guess the processing times are not always accurate. When I got mine, they said they were processing cases dated mid-August or something.

I hope you'll here from NVC soon.

Yes. Presently the NVC is still requesting 3 years tax returns even though some consulates and a recently released DOS policy are saying that only the most recent is now required. I would have 3 years in readiness.

Have a read of the NVC timesavers link in my signature. Many members have also been emailing NVC with their Choice of Agent, and having no problems doing so. There is a sample email in the link.

Also have a look at the NVC Flowchart http://www.visajourney.com/examples/NVC_Process_Flowchart_v1-2.pdf It will show you the steps.

The IV Bill which is for the Immigrant Visa. The application being the DS-230

No. You must file everything sequentially. You should not submit anything to NVC until they have generated each step. See the Flowchart link above.

Anyone that enters on a K-3 visa has the option of returning to the Consulate for the CR-1 visa and re-enter the US where they will have the green card. Nothing much else to do then until one is required to lift conditions.
