Thanks Khurram and chicago. Also please list all forms US Consulate sends to beneficiary. Can I download those forms and have them ready for my wife?

The only forms needed for CR1 at the embassy that I know of is Completed and signed DS-230 Part 1 and 2 forms and I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required.

Opinion regarding nikah and I-130 needed ....

A lot of people do nikahs in Pakistan and than come back and file for I-130 and at a later date go back and rukhsati happens.

My question is .... technically ... can you file I-130 if the marriage wasn't consummated (which is rukhsati, right)?

I have a cousin that did that and was fine so I think yes you would be fine

Its been more than 10 days since I sent letter to NVC to upgrade my wife's case and I haven't heard anything back. Do they usually take this long? I am starting to get worried now. Does anyone have experience with NVC upgrading a petition? please share your thoughts. Thanks

I thought they took approx 30 days to upgrade a petition but don't know for sure

As far as I know the legal document that establishes the marriage date is the Nikah Nama. Islamicaly and legally you are considered married on the date in the nikah nama. The delayed ruksati is just cultural horse***t. I do not think consummation comes into play at all.

This is what my wife took with her

1. Copy of I-130 approval

2. Marriage Certificate

3. Birth Certificate (original, copy -Translation and copy)

4. Affidavit of Birth – original and copy

5. Copy of School records - Matric, Inter BA and MA

6. NIC (National ID card) – Original and copy

7. Police Certificate – original and copy

8. Medical Report

9. Emails -Cards

10. Phone bills and calling cards(home)

11. Copy of Passport (Khurram- to show dates of travel)

12. Wedding DVD

13. Photo Album and Wedding invitation

14. Consulate Papers - (Interview letter and all documents they had send)

15. Wife’s Passport

16. Wife’s Old passport

17. Photographs - Photos

I sent her my tax returns (past three years), my Certificate of Naturalization and copy of my passport in addition to what Khurram has stated. I also sent bank statements and letter from employer because when I emailed embassy they replied and asked me to have the bank statements and a letter from employer, if possible. Proof of payment of $380.00 at NVC, because the interview letter stated that she needs to pay $380.00 at the embassy, so if you have already paid at NVC, send a copy of money order or certified check if you have.

This is what packet 3.5 (CR-1) from the embassy asks for:

1- Ds-230 part 1 and part 2 (remember you sign part 1 but do not sign part 2, you sign it infront of the CO).

2- Orignal copy of Marriage certificate and translated copy (if marriage certificate was in Urdu).

3-Police Certificate.

4-Medical report (no X-rays reports).

5-Death or divorce certificate of previous marriage (this options only apply to Beneficiary).

6- If I-864 is not submitted at NVC, must turn it in with Packet 3.5

7- If I-864 submitted at NVC, then the beneficiary must write a 1 page letter stating that the petitioner has submitted the I-864 at the NVC.

8- 2 pictures.

9- orignal copy of Birth Certificate and translated copy (if orignal was in Urdu).

Calling probably wont make a difference, but it gives you something to look forward to every 3-4 days.

I know this has been answered before, but I must ask again. My wife's travel agent continues to insist that she'll need a transit visa for the UK.. when her PIA flight will travel from islamabad to chicago and stopover briefly in manchester.

Every website I've checked states if you have a US entrance visa, you don't need a UK transit visa. I've asked her to talk to PIA directly and/or a different travel agent.

Unless, rules have recently changed, could someone confirm that they did not need one traveling through the UK to the US on a K3 visa?

I know you don't need one and Ali's wife just came on K3 without a transit visa.
