I-130 and 1-129f application question

I was reading throught the documentaton and found several options i had questions about i hope some one could answer.. We were married in el salvador june 30th and i am just starting this process.. scared and confused :crying:

do you have to send both forms together or are they suppose to be seperated

does the 190.00 fee cover both of the dcuments ? becuase i read that the 129f is 170 so is there two seperate charges i have to send or should i just send one?

is one faster then the other>?

I belive both are seprate forums. 129F is fiance while 130 is CR1/IR1. Please I recommend checking with people who are from same country from where your SO coming. Its always easy and accurate that way. LIke i always tell other fello VJers to call NVC please do not hesitate Call 100 times They will answer.

As you are married, you file the I-130 first and pay the $190 USD. Then, if you want to go for a K3 visa, you would file the I-129f as a spouse with the separate $170 fee. See the K3 guide for instructions on that. The complication right now is that the fees are about to increase for most petitions but the I-129f is about to be free for married couples going for a K3 visa.

In my opinion, if you want a K3 visa, the safest route is probably to file the I-130 now with the $190 fee and then use the instructions somewhere in the K3 folder here to file the I-129f petition with the $170 without the NOA1 from the I-130.

If you only file the I-130 and there are no serious problems along the way, your wife should have a CR1 or IR1 immigrant visa within a year.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

If you are ready to file in the next few days, you an file both together, directly with either California or Vermont. Yes you pay two separate fees. If you file the petitions received July 30 or later, you still file them together but pay one higher fee.

Please read the guides to familiarize yourself with the process.

Be aware the filing instructions are now different from what you read on the instructions that come with the form. The new procedure will speed things up by at least a few days for most people.
