sending a 129f without the NOA1

I am scared I will never get my receipt. Can I just go ahead and send my 129F with proof of mailing and get away with it? HAs anyone else done this and what did you do? I dont have access to the receipt number cause I used money orders.. Can I get away with this?

Yes, send it directly to CSC and make sure it is labeled clearly as for a spouse and K3. Do you have a copy of your cancelled check to incluce as evidence of filing? Case number?

Actually prior to July 30th the I129F for K3s goes to the Chicago lockbox.

You must show evidence that an I-130 has been filed. I don't think a proof of just mailing it would be enough. I believe they want a copy of the NOA1. You can try to send it without proof but don't be surprised if you get an RFE. You only filed about two weeks ago. Sit tight, I'm sure your NOA1 will arrive any day now.

no they said that they are accepting them early. california is very slow about noa1s

Your information is out of date. In the same memo that indicated filing instructions would change July 30, they indicated they would accept petitions filed that way now. Several of our members have successfully filed I-129F peititions for spouse, using other evidence, such as cancelled checks etc.

You will need some evidence of having filed. Check out the May and June K-3 filers thread, some have done this. Try calling USCIS customer service to get your receipt number. Then include a printout of your case status from the web site. Your receipt number for the I130 should give you the proof they want.

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

You may get away with sending the I-129f without a Receipt Notice for an I-130, but not without sending some other evidence of having submitted an I-130.

Hi and best wishes!!

1) It is pretty important to have your Receipt# and the I-797C to attach to the I-129f. Had you used a CHECK instead of a Money Order, you could have gotten this number from the back of the cancelled check.

2) We filed our I-130 and got our I-797C back in about 3 weeks from CSC. I did not feel that was a long time to wait. Be patient and wait for your I-797C and when it comes...make 10 copies of it for your records (a little overkill never hurts) in case anything else ever comes up. Besides you want many souvenirs of this process, don't you??? :whistle:

3) Yes, you could and can do just about anything you want with your papers. BUT, why risk them getting lost or misplaced without the proper I-797C attached? I recommend you wait a week or 10 days and something should happen.

I still havent gotten it but my lawyer did. I do not know how I never ended up getting one. I do not think they send you them if you have an attorney.He emailed me yesterday and let me know he had received it. They got picked it up on the 25th and by the 2nd of July my NOA1 was issued which is one week which I think is pretty fast. Its already at the CALIFORNIA PROCESSING CENTER. I do not think I will be getting notices of Action because I think the lawyer will get them and not me.
