Should I continue with my I-129F application?

Timeline

I have recently got approval for both the I-130 and I-129F applications for my wife and child. My question is, should I drop the I-129F processing altogether? I was thinking that we may proceed to finishing off the I-130 instead while my wife and child are still in England. What are the downsides?

Only downside is it might take a little longer for the I-130!

Besides that the I-130 [CR-1/CR-2}] are MUCH MUCH better visa in ALL ways!

I believe uscis will make that call for you.

My understanding is that since July or so last year, they hold your I-130 in america when you file K3.

Then use your I-130 when you apply for AOS.

To get them to process your I-130 as well as your I-129 you have to file another form (and pay fee) I-864 I believe it is.

The I-864 takes about 2 months to process, so by then your K3 is way ahead of your I-130, so chances are slim your I-130 will get processed out of nvc before your k3 is complete.

Well, that is my understanding anyway, perhaps an expert out here can give you better info.

Well you say both are approved. If they were approved together the above is correct except the fee is $200 and the form is an I-824. Nobody has reported any action on their I-824 in less than six months.

I agree with pushbrk. I think that you are stuck with K3 unless you are willing a wait a really long time for the I-824 to get through. The best course of action when I-130 and I-129F are approved at the same time is just to go with K3.

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

I agree with pushbrk. I think that you are stuck with K3 unless you are willing a wait a really long time for the I-824 to get through. The best course of action when I-130 and I-129F are approved at the same time is just to go with K3.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
