Working (Illigally) in USA w/ J1...does it affect decision?

My wife was here in California for 2 years on a J1 Visa (Exchange program) which does not allow individuals to work in USA. She did work w/ a valid SS # for approx 15 months. Now in Peru, her interview for K-3 Visa is this Monday.

Does anyone have any idea as to weather or not this may affect their decision to grant Her Visa?

Any help is appreciated, and best to all.

As far as I know, this is one of those things that are forgiven because of marriage to a USC.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Read the the laws to make sure but make sure you are aware of them. One of the questions on the I-485 application is Have you ever been a J nonimmigrant exchange visitor who was subject to the two-year foreign residence requirement and

have not yet complied with that requirement or obtained a waiver? This may be something to address when she gets here and you file your I485.

If the J-1 visa holder was subject to the two-year foreign residence requirement, she would not be issued a K-1 visa, until that requirement had been met or a waiver obtained....so it would not come up at the I485, in this instance.

That question and answer would be a factor if marriage occured here in the US, w/ the foreign national residing here.
