Yes, for domicile but the NOA1 and NOA2 will only be sent to a US address, when filing at a service center in the US.

We live in Canada and our NOA1 and 2 were sent here, so I assume that is only for K visas or certain countries? (I didn't even realize when I posted earlier that I had wandered in to the K forum!). Or is it because when we filed we had no option to use DCF?

It was my understanding USCIS service centers in the US only send mail to the US. Perhaps they make an exception for Canada or perhaps I'm mistaken.

Facts are cheap...knowing how to use them is precious...

You all have been so helpful. I appreciate every bit of information you've given me.

Margot about the tax returns. I've been a stay at home mom so I haven't filed. Well I filed the last tax return from here which was income I had made in the US. I have NO US accounts open. The only bill I've had from the states is my student loan which is being paid on by me sending the money home through paypal and family sending it in.

About the co-sponsor; at first we will probably stay with family until we both get jobs, but we will move out quickly afterwards. Do you think I would still need a co-sponsor for all of us or would it be fine to just put my income as $0 with a joint sponsor? thank you you all rock

I don't know how to go about it, but you will need something to prove that you did not have anything to file. I recommend opening a US credit card or checking account over the phone, using a family member's address. The credit card should be easy as long as your US credit is fine. I did it once over the phone from here in the UK and had the card sent to my parents' house. The student loan payments will also show domicile.

I'm sorry I don't quite understand your question about the joint sponsor. Perhaps I was confusing by using two different terms for the same thing. Co-sponsor and joint sponsor are the same thing. You will be the main sponsor and list your income as $0 and your husband's co-sponsor/joint sponsor will also fill out the I-864 and have to have enough income for their household.

You are not required to file a US income tax return if your earned income is than the exclusion amount for a given year, and your unearned income was less than the exclusion amount for unearned income. No other proof should be needed, just state that. The only thing to note, is to make sure that your unearned income wasn't over the exclusion amount of $850. If you earned interest/dividends or other unearned income over that amount, you should file a return.

This is only true when living in the states. When living abroad, I have read posts from several people who had to obtain proof of some kind that they did not have to file. And it was shown at some point in the process, I believe at the embassy. I can't remember all the details; I just know that others have had to deal with it.

Ok, thats fine. I am no expert on immigration processes and requirements. If you earned some income, but below the filing requirement, you could use your pay stubs and/or an employer statement or contract to show proof you don't have to file. But, if you earned no income this would be hard to show proof other than your own sworn statement. In that case, you should open an interest bearing US bank account, and file reporting you minuscule interest income even if its below the requirement threshold. I was just saying that the IRS doesn't require filing or to show such proof. I spent more time going into the details of that here:

Have you decided on the K3 path instead of the IR1 visa? You have only six months to enter on the IR1 visa but you enter with full rights of a permanent resident including the right to work. With the K3, you must file for AOS after entry. By then the EAD for work authorization is included with the required $1010 AOS fee. You don't pay that fee or wait for AOS and EAD when you enter on the IR1 visa.

I thought you had decided on IR1.
