Do I have everything to file the I-130?

6. Photo copy of Husbands birthcertificate both sides

7. Photo copy of Marriage License both sides

8. Affidavit of bone fide marriage from biological mother of USC and Friend of USC

9. Photo copies of pictures of the couple

Questions -

1. Do I need to get his Birthcertificate translated into English?

2. Can I send a personal check?

3. Do I really need to send in the photo copies of the pictures at this time?

4. Anything else you all can think of that I will need?

2) YES, a personal check is easier for you to track, you can easily get petition numbers that are printed on the back

I agree with YuAndDan. One thing, do you really need the birth certificate's copy of the non US Citizen beneficiary? If you don't need it, don't send it.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

The non US Citizen will need to take his/her birth certificate during the Immigrant Visa interview. So it is good to obtain it now.

Why a Cashiers Check? With a personal check I can track it in my checking account. Can you keep a tracking of the Cashiers check? Will I know when it has been cashed?

You can use your personal check so that you can track it, as you said.

I would use a cashiers check......
A cashiers check is a big waist of $$, USCIS has the case, and if a personal check bounces, they can just hold up the case, and charge you for the bounced check, no loss to them, the check does not need to be guaranteed.

A personal check is perfectly acceptable.

You probably won't need them for Juarez. I just came back from a final visa interview in Juarez and they never asked for translations but I had them just in case. I would recommend you send them for your initial filing in the US and make copies and keep them when you go to Juarez . ALso, why JUAREZ? do you know there is a one year wait for them to give you an interview date from the date NVC sent your case?

2. Can I send a personal check? NO, you will need money order. Keep the receipt.

3. Do I really need to send in the photo copies of the pictures at this time? I would send them too. You first have to convince the officers in you initial filing that you actually met your wife or wife to be. But make copies of photos you sent so that you may have extra copies when you go for final visa interview (between 1 or 2 years wait!!)

4. Anything else you all can think of that I will need? Patient, lots of it. ALso, makes sure that there no discrepancies between in birth certificates, passports names and those you put on the form. Very important that all names are the same as the one on the application and/ G325 forms.

The last post was incorrect in stating that you could not send a personal check. As many others mentioned - a personal check is fine - and is recommended since you can obtain your case number off of the back of it once it is cashed. We just sent out I130 on May 22, 2007 and our PERSONAL CHECK was cashed - and CSC received our form on June 8th.

I don't see where in the I-130 instructions they ask for the spouse's birth certificate. If you look at the instructions, number 7, section A, it provides all the requirements. I-130 Form. They do ask for birth certificates if you are petitioning for a child or parent. If you look at the link provided for the checklist elsewhere on this thread, you will see the item asking for spouses birth certificate is crossed out.

Now, they've recently changed the I-130, so it's a slightly different form than when I filled it out almost 2 years ago, but we didn't have to translate my wife's birth certificate (she's Mexican, I'm the USC). In fact, we didn't have to translate any documents. For CDJ, Mexican documents presented in Spanish do not have to be translated.

Again, double check, but you don't have to translate your spouses birth certificate because they aren't asking for a copy of it in the first place. And when you go to CDJ, the birth certificate is just fine in Spanish.

Everything going to USCIS has to be in English. That said, I agree that a BC for the foreign spouse isn't necessary at this stage.

In CDJ, as you said, documents in Spanish are fine. If further AOS is going to be required in the US, documents do need to be translated.
