Marrying after K-1 is received

Timeline

Once a K-1 Visa is obtained, I understand you have 90 days to marry. My question is, "Do you have to be married in the United States? Or may you get married out of country? (ie) on the beach!!

As long as the beach is in the US :P

You have to get legally married in the US, also remember the K-1 is a one time entry into the US, but many people have travelled to places like Hawaii or Puerto Rico to get married on the beach. Im sure the others here will list some more places you can get married and not have it affect your status.

but one quick question - one time entry meaning even after we're married i can't leave the US?

One you have got married in the US you will need to file for AOS if you file after July 30th when you file for your AOS you will also get an Advanced Parole which will allow you to travel outside the US before your get your Greencard....

Once you have your Greencard you do not need anything other than your foreign passport and greencard to travel....

but you MUST get married in the US.....

Sure you can leave. You can't come back using the K1 visa, as you've already used the 1 entry allowed for the visa.

perfect - that makes sense now from some of the research i've been doing....kind of cool when all the pieces fit together! i'm just in the initial stages (simply researching), and it was/is INFO OVERLOAD, but things are making sense now. this forum is wonderful - and so are the people willing to help!

Once you get married you have to apply for adjustment of status - for your green card (residency).

When you have that you can work legally and travel no problem (as long as you don't stay out of the country tooooo long).

If your green card takes awhile to get approved (could be 2-3 months/could be 2 years) then you can apply for a work permit and/or advanced parole.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
