Hi all-

I received the hard copy of NOA2 today in mail. It says "We have sent the origial visa peitition to the Department of State National Visa Center..........."

Is that a standard on all NOA2's ? or does it sometime says "We will send the original........"?

What you're seeing is a form letter. It's going to say that on all the letters they send out.

It's 180 days for me today. Whoopee! I called the CDC (California Disservice Center) to wish them a happy anniversary.

The automated line said "You are required to provide the information requested." "Good grief -- an RFE!" I thought. I continued and immediately reached an actual Immigration Officer.

This ImmigOff was the only truly helpful, sympathetic person with whom I've ever spoken at USCIS. He did not argue with me once; he actually provided meaningful information without pull-teething; and he said that he gets enough calls like mine that he is absolutely obliged to respond with courtesy and respect. Would that the other b*stards there had the same approach!

He said that his records showed no RFE at all, and he considered it curious that the recording said that there was. My file is "not in the file room; it's in the Division, between officers' workstations at a transit station." I queried him; he surmised that a junior officer couldn't make a decision and referred it to a senior officer, OR approval/denial could be awaiting a supervisor's required signature.

Helpful poop for all of us: He said that 90% of fiancee petitions are ultimately approved. He said that the official holidays off for the "workers" (ha) at the CDC are the day before Christmas, Christmas Day, & Gnu Year's Day; of course, folks will also take personal time during this period. Case Status Online is NOT always updated because [1] "It would distract the folks from processing files" and [2] "There would be so much strain on the computer system that it would crash it."

He did volunteer that my fiancee has an Alien (whoops -- "Administrative") Registration Number (assigned shortly after the file was received -- thanks, USCIS). He projected early January for action on my petition. (Whoopee -- my VJ date is October 29, 2007.)

Now, dig this: At my request, he promised to send the "black hole" (his words) an e-mail stating that the Case Status OnLine flatly says "We process cases in the order received" and that July/August files have been approved before mine. He said, "I can't promise what reaction it will evoke, but we can try." I asked, "Will they cram my file at the bottom of the pile out of spite?" He said, "They're not SUPPOSED to, but we're all human." He further added that it is probably better NOT TO CALL USCIS MORE THAN ONCE A MONTH. He added, "The last call of yours that I have on record is in September. The people you talked to thereafter probably did you a favor by NOT logging those calls." I asked whether the workers were flat-out irritated by "too many" calls, and he said, "Well, I won't say that they aren't, so try not to call for at least another 30 days if you haven't heard anything by then. This is one reason that they have us (contractors & ImmigOffs) running interference for them."

Well, THIS information is an eye-opening kettle of fish. "Petitioning your government for redress" (Article I, U.S. Constitution) does not apply to USCIS. This must explain why Congressional inquiries on our behalf, which used to result in action (see thread from former NSC Adjudicator), are no longer heeded.

TboneTX, I'm nearly the exact same time filing as you are and still waiting, too. I called them last week and of course, didn't get much out of them. He told me if I was disputing the date of April 29th as the cases they are working, I could make an appt with the local office here. I told him I was not disputing that, but the fact that they work the files in order of receipt which is obviously not the case. Your last call seems to have reached the only nice person working there.

I wonder if my file is somewhere with yours... in the "Division".

Sympathies and empathies, SSAH. The whole operation is a crock, and I certainly did reach the only nice person there -- I absolutely still want to throttle all the others. My IMBRA guy (matchmaker) says to just do other things, and then magically one day the approval will come.

Well....I found you information interesting.....they must of been in a talkative mood today because....Elizabeth.......was just as informative....she actually did not read off of a script.....I am Lora and I filed at VSC June 5, 2007 so that puts me at 191 days.......anyway I explained to her frustration I have with 1. no recourse for the petitioner on the breech of contract with USCIS....2. the change of the processing date not being accurate to the reality that customer service says they are processing...ie website say less then 6 months but for 4 weeks now it has been May 19th....in fact at one point they went backwards...and 3. they are processing out of order.........she tried to override the system to get through to someone at VSC but was unable to but had her supervisor come on to the line and I talked to her she said she would write up a request for clarification........probably nothing.... about 2 of the issues.......DHS complaint line...which I downloaded the form and sent it off but I have no hope for any of it.....they are in control and really could care less....sorry to say........I have called or emailed Conressman, Senators, lawyers and I have a call out to the ACLU but nothing nada, nil.....I just hate USCIS.....the bottom line.......

Lora, I fantasize about being elected President, and -- not during the first 100 days, but the first DAY -- going to CSC (their processing date is April 29!), chewing some butts like a Marine drill-sergeant, bashing heads, throttling throats, and making sure that none of the survivors ever get jobs anywhere again. Then, the procedure would be to handle applications from U.S. citizens FIRST -- none of this "H1-B visas take priority, and then spousal visas for the H1-B awardees" insanity. If the Center can't immediately track down the very NEXT application chronologically, all activity stops until it is found. If it is not found within 15 minutes, heads roll. Now, THAT would be payback for losing our right to "petition our government for redress"!

Well I find that a wonderful fantasy but you have to include VSC also just to help the other half of us....O.K.....I got an email back from the ACLU asking me to write up the whole situation and how I feel my rights have been violated...OMG....let me count the ways......by the way TBoneTx I met Oscar in Quito, Ecuador though he is Peruvian....One of my favorte places I have visited........My favorite resturant overlooks the old bullfighting stadium in the old section of town...good food and what a view at night....beautiful.....You know we all should be spending time with our SO instead of fighting our own government for the permission to be happy.....THANK YOU USCIS....for your concern for your "customers"

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
