Need Advice Again....

Timeline

If our fiance visa is denied outright, could we get married and apply for spouse visa???

OR

If our fiance visa is sent back to the USA for further review, what would happen if we went ahead and got married?

We wish now we had already gotten married and filed for the spouse visa instead of the fiance visa.

Any advice is greatly appreciated. BTW, our papers are still in CA, no word since they were sent there the first week of April. Could you please give the address again of where the list is for April filers???

If your petion went through CSC, you are looking at getting the NOA2 no learly then the first week of Juy, so its a bit early for you. It could be even August. I know how hard it gets at the end and you just want to see that approval, but you are well within a reasonable time.

Why are you now thinking so much about denials? I know its good to be prepared, but denials are not as common as they seem to be when reading VJ.

Debbie i think you could still cancel the one you have open now then get married but you cant have two open cases at once. As we have talked if its returned it will take awhile to get the notice that it has been cancel/denied, then i believe you can marry and refile but your talking alot of time and the problems that you are thinking about will still be there even if married. Get with me and ill give you some names of people that have done this.

Maybe you need go back Safi its not that hot over there (yet) :thumbs:

Just my 2 cents worth but I think you should try to relax a little and enjoy your visit there with your honey :) . YOu do seem to worry a lot about denials and while we ALL worried about that at some point, its ok to have some optimism too. if I recall correctly you are worried about an age difference? A lot of people get approved in Casa with an age difference (my situation included) and whatever issue you are concerned about is going to exist whether you are going for a K1 or a K3. Marriage does not exempt you from their scrutiny or their bias if they choose to have it against you. IF for some unfortunate reason you have a problem at the consulate level, and we all know it does happen, there are some great ladies on this board that have experience and can help, but cross that bridge when you come to it and try not to lose any sleep over it at this point...

Seems lately like Casa is on a good roll so spend this time preparing evidence for interview, etc. That you are there visiting again right now is a good thing! (take a lot of photos to add to your evidence pile ....)

just try to have fun in that crazy moroccan summer heat, and drink a glass of fresh juice for me in the square!

Not trying to scare anyone but don't married couples get denied also? What I'm trying to say is I don't think it would necessarily guarantee an approval just because you're married. I never dealt with Casa so I don't know for sure. But it seems that way.

No you are absolutely right. K-3s get denied just as easily as K-1s. There is no advantage (for the consulate approval) to being married. The problems you have are the problems you have. Couples need to prepare going into this process and every step along the way to show legitimacy.

my fiance noticed in the consular office the other day there were a lot of younger men interviewing for their older american wife. he said the huge majority of them were for the k-3 visa. so we could maybe assume there must be something going around to suggest that they are better off with the k-3?

Not so familiar with your case, so I have really no idea what *real* advice to give you.... buuut I think you should exam why you would think your petition be denied? Then go from there. That way you can 86 those points, that *got* you denied and fix them (enchallah) ... buuut as Moody and MBP mentioned there is no difference between k-3 and k-1 denials.

In my opinion, the man wya you could be denied, is that they say you lack enough evidence of your relationship. And with either k-1 or k-3 they could deny you either way. Unless it took you several months and trips to be married, being married, then leaving after a day or 2 will not convince the consulate you are "married". That to me, sorry to say sounds like fraud. So anyway, in my humble opinion get as many proofs as you can, file which ever petition you prefer, and if you get a denial, prepare to live with your SO (that is the best proof) refile and pray for the best. Also with some consulates, like Egypt and Morrcco, where it seems they are giving ppl a harder time, we all should assume they will send most if not all petitions back for further review ... I would calucate that into my timeline if I were you. Better safe then sorry.

I've heard Moroccan men say that the think the marriage will show a more legitimate relationship, but it's just not true. I chalk it up to the Moroccan visa gossip mill.

I am one of those married that got denied from Casa, but it was the CR1, not the K-3. The K-1 is likely to expire, whereas the K-3 and the CR1 probably won't, depending on the consulate. My advice is to stay on the path you are on now, don't stress, prepare well for the interview.

Although an expired petition sounds bad, it really is not as bad as you might think. The alternative would be that it sits at the CSC for readjudication. This is very time consuming. They received ours back in Dec of 2006 and they didn't reajudicate ours until Aug of 2007, and this was actually speedy. When it expires, they don't make you wait that long, so you can file again once you get notification. If and when that happens you can get married if you choose, and prepare your intitial petition better.

There is a possiblity it will be denied, but there is another possibility that it will be approved. Someone gave me this advice as I was stressing about our interview "Hope for the best but prepare for the worst". How true that was. And don't worry, if it does happen there are people who can guide you through this as well. My husband and I waited 15 months after his denial to get a second interview. It may have felt like forever, but he is now here with me for 7 months and we are incredibly happy...it was worth the wait.

Maybe I missed something but do you think you're going to get denied for some reason?

If you want to be together ASAP then I would stick with the K-1 and go through with it. If by chance you get denied then you can get married and re file a K-3 or CR-1. I think it's worth it to keep with what you're doing, and if you do get denied it will only set you back a month or so in the end.

A month???? I can't say I know where you figure that. The process is a little more complicated than that, even with the K-1, and even if it expires.

our inteview was in April the papers are just now back in Calif on June 12th with instructions to not even think i will hear anything for 6 months from them either way....and it expired the first week of June...its a little more complicated
