I just checked the processing times at vermont, before it said february 13 not it says 6 months :unsure: WhaT? I don't get it.

I just called VSC, using the RFE Trick, No help :( They told me they don't check case status there...haha! It seems that the RFE Trick doesn't work for me....Can you tell me what is the first thing you say to the person who answers the phone!?!?!?! haha! Maybe I'm saying something wrong.

After that, I called USCIS, since they updated the website and now it says 6 MONTHS, they told me it is going to take 6 months from today......Whatever, I'm done with this.....It is really annoying and sometimes I just want to give up and forget about all this.... :crying:

Same here, I just called in, and was told that request to have an inquiry into the case status cannot be done until 6 months of the date they received the file. I think it really all depends who one talks to; as always, they have no consistency... This is absolute rubbish! :protest: :protest: :protest:

Every time I called VSC I said I wanted "to check on the status of my case" and I was told to call customer service and they gave me their generic answer.

Then I decided to call again but instead I said that I had sent in my petition in May and hadn't heard anything and wanted to know if there was a problem with my petition. That is when she told me that I should be hearing from them soon.

So I guess wording is important when talking to the folks over at VSC :)

The can't freaking do that...I don't think they will but still, if that would be true, now they will make people wait 6 months more???? We filed on May, #######! That would be 9 months....I think I give up really....Sometimes I just think stupid things but you don't choose the love of your life, it just happens but too bad we have to go through all this.

Wow. I am stunned. We have gone from unrealistic optimism :goofy: to utter dispair :cry: and anger :ranting: in the blink of an eye. Hopefully we can back to some middle ground.

At the risk of coming across as a "know it all" here is my evaluation of the situation for what it is worth. This applies primarily to K1 filers because K3 processing times seem to be much longer and erratic.

April Filers: Since most April filers have received their decisions already, there is possibly a "problem" with your petition. This does not mean that you will be denied, but it may be an extra background check was required or there was an RFE. There is not much you can do about it until your petition is 6 months old. (See below) Until then, you will need to continue to wait and hope for the best. As long as you received a NOA1, you are in the system and you will hear eventually. When 6 months has passed since the day your petition was physically received at a service enter, I would suggest getting on the phone. Tell them you are outside the published processing time and you want to know what is going on. However, if you received an RFE, USCIS will not start the 6 month service commitment clock until you return the requested info. (See below)

Hopefully you will have your decision before you get to the 6 month mark. :clock:

May filers: May petitions are currently being processed so be happy you did not wait until June or July to file. :dancing: As compared to the rest of us, you guys are sitting pretty. I know you are impatient for your approval, but you should hear soon. You have waited this long, you can hang on a while longer!

June, July & August Filers: I don't know what to expect for processing time although I think it is very doubtful that VSC will be returning to its glory days any time soon. The current rate of approvals would lead one to believe that we will have very long waits. :( Things may eventually improve however. See below for my personal theory.

Here is the deal on the USCIS stated processing times as stated on their website on August 15th. I edited their statement and added some comments for clarity. You can read the original text here.

.......... Effective immediately, when we are completing applications and petitions within our service level goals we will report the USCIS service level commitment. For example, when our service level goal is to process a particular kind of case within six months, and if our processing time is six months or less, we will show "6 months" (as our processing timeframe on the USCIS website). Note: K1 service level goals are 6 months.

When we are not meeting our service level goal, the date posted will reflect the filing date of cases that are being completed. It should be noted that while in some instances reported processing dates may appear to have regressed due to this change, they do not reflect a lengthening of USCIS processing times, but simply the change in reporting. Our goal is to provide accurate projections and thus give customers clear expectations as to what they can expect as a processing time.

There are several important exceptions to the processing times shown below:

Case processing will be delayed if we must ask you for more evidence or information. (RFE's) If we ask for missing required initial evidence, count the processing time from when we receive that missing evidence. The case processing timeframe will start over if a customer doesn't appear for an interview or asks that it be rescheduled.

My interpretaion of all this is that USCIS has set a standard of service for processing K1 petitions of 6 months. I don't know exactly when the clock starts running. It could be one of the several receipt dates or the NOA1 notice date. For most of us those dates are not that far apart, but of course for some they can be quite different.

As long as USCIS is processing K1's in 6 months or less, they will state the current processing time (Processing Timeframe) as 6 months. So even if they are processing petitions in 3 months, they are still going to quote the processing time as 6 months. If processing is taking longer than 6 months, they will state the actual dates they are processing.

So, the only thing we can learn from looking at the current published K1 processing times is that they are not taking longer than 6 months. As long as the K1 processing time is less than 6 months the USCIS published processing times are not going to be much help to anyone. You can get much better information here on the VJ site.

The other thing to keep in mind is that if K1's are being processed in 6 months or less, the USCIS is happy because they are meeting their service level committment.

As to why things slowed down and they might eventually improve, here is my theory. I have no inside information so take this as only one person's guess as to what is going on.

1. A lot of employment based visas have higher priority than K1's. This can be determined by studying the published USCIS processing times. (Scroll down toward the bottom of the page and look at the I-129 procesing timeframes.)

Now my guess is that many employment based visa petitions are filed and paid for by employers. Since they are in business, they are probably more price sensitive than us love struck fools, so the pre price increase surge for employment visa petitions was probably much greater than it was for K1's & K3's. The surge in employment based petitions probably began in June and continued until July 30th. Since the employment based visa petitions need to be adjudicated in roughly 60 days or less they would have been given higher priority over the K1's & K3's that were already in the system. And there you have it, instant slow down for K1's and K2's including those submitted in May.

2. Now the employment based petition surge would have stopped by July 30, so all those petitions should be processed by the end of September at the latest. When that happens, K1 & K3 processing times might improve because they will be bumped less often by employment based petitions.

3. The unknown factor is how much of an impact the Texas petitions that Vermont is now processing will have on processing times. Assuming that Vermont did not hire more adjudicators, it cannot help but slow things down some.

So, that is my two cents. If you agree or not I still killed a few minutes of waitng time. ;)

I am a June filer and I reckon that the approvals will start being sent out within the next few weeks.... May filers have really been in the same time frame haven't they? A lot of them have waited around 4 months which at the moment seems to be 'the norm'

February 13th 2008 - Packet 4 received

March 4th 2008 - Medical @ 1.00pm

March 5th 2008 - INTERVIEW @ 10.00am - APPROVED!!

March 11th 2008 - Visa received!

April 30th 2008 - Flying home at last!!!!! (POE: Dulles - Washington DC)

July 12th 2008 - Wedding date!

Now for AOS!
