This started a few years ago but on Jan of 2005 I filed a I-130 petition for my wife in the Philippines and after a year passed her interview date was in March of 2006. A week before the interview we had an arguement over the phone basically pressuring me to join her religion, I wouldnt budge, then she told me that she wouldnt go to the interview and I thought it was a bluff but apparently she really didnt go and then we had a falling of our marriage but we didnt divorce. After a few months I got a letter from the USCIS stating that the petition was withdrawn.

Last February the wife and I started talking again and have patched things up and now the both of us are certain that we want to be together again. Here is my question, can I reinstate the petition ? do I have to refile again ? does anyone know if the USCIS stores a copy of the pictures and forms that I sent them ? the reason that I ask about the pictures is that I need to send pictures of the wife and I together as supporting evidence and the only pics that I had was the one that I sent to the USCIS, is there a way to request these pics back ? or do they destroy them ? do they keep them ? how long is it stored ? If someone has info on this I would greatly appreciate it.

thanks in advanced !!!!!

I had done the same thing last year with my wife now who decided not to come to US with a fiance visa so I had to withdraw it after few months of sending it to the USCIS. Now after getting married in Feb I reply but this time as a relative. What I had to do is resummit a entire now packet to the USCIS because to my understanding there is nothing you can do to get the old petition and I-129F packet back. Sorry I think you need to find a way to get new evidence for your new I-130 petition. Gud look, Pal!
