I have been putting HCM on my place of birth on all the forms. I Just got my birth certificate, (which is a made up one, I was an orphan in HMC) and it has a different place of birth. What is really funny is that the mother and father on the Certificate is my Adoptive mother and Father. Do you see a problem when Tuyen has her interview?

Of course it is a problem! Matching birth-place is quite important in any official document and matter.

Quick, get all worry and don't know what to do about it! :D

I don't know what HCMC will do to your case but when you submit your application, were they awared that you were an orphan? were they awared that your BC will be submitted at a later time? Basically, with the "latest and greatest information about your actual BC", made-up or not, they will use that BC going forward. Considering, this is NEW information to you as well.

HCMC does not set out to get people for what they didn't or don't have, nor yet to obtain. If they ask why you gave them HCM as your Birth Place instead of the other, most likely your adoptive parents' or your adoptive father's Birth Place as yours. Explain it like you did here and that's that! Unless you lie then nothing to worry!

I emailed the Consulate on what I should do and contacted my congresswoman to help sort it out for me.

I think it's a problem, but even if it is, you're doing the best thing you can by getting into it now.

You're already doing the right thing by investigating it. I might even contact the USCIS if I were you in case your G325 (assuming they still use that) needs to be ammended. Take no chances on things like this.

I just got off the phone with the USCIS. Since it had already made its way through their system it is a DoS issue. The Immigration Officer I spoke with had to ask his Supervisor. He seemed to think that the Consulate has had to deal with this kind of thing. He said that it shouldn't be an problem, but I'll wait until the consulate tells me otherwise.

Doing the little reaseach It appears that Binh Hoa and Thanh My Tay were 2 wards in the Go Vap District. There were combined into the Binh Thanh District in 1976. If someone knows a little about VN history from around '75-'76 could you verify this?

My congresswoman's Liason talked to the NVC and they do not think it will be a problem as long as the Consulate is notified of the situation. A little more weight removed.

If I am not mistaken, those AP and KHOM and XA all part of the suburb of Saigon. Used to be very rural areas but no longer the case nowadays. It's all part of HCM City. So, it's like people who live in Montco or Delco, counties surrounding Philadelphia, still tell people they are from "Philly", but technically, they are living the suburb of the city of Philadelphia. At least that's how we do it here in Philly! I know people in Saigon claim they from Saigon, even if they live far as heck from Center City. As many have mentioned, just make sure you send the Consulate a note stating: I do have the EXACT address and here it is... blah blah blah! Done! Still, you're not lying about you were born in HCMC.

I wouldn't worry about it. Remember, you claimed you are an orphan!!!! Well, that explains a lot why you would mix up your actual birth place, not too many infant and orphan know where or exactly when, if ever, they would know the truth beside what the adults in their life tell them.

I want to say: I TOLD YOU SO!!!!!!!!! but i forgot what I've told you :) Had to read the previous post! Yes, the consulate doesn't like surprises... Let them know upfront and back it up with your latest and greatest BC issued by your US town/city/state/federal government, they will and must accept it! :) That's the beauty of one unified law and government system we enjoy but take for granted in America!!!! Think of Vietnam, your local government issues a piece of paper claiming you are XYZ, take that paper to a different province, they may or may not accept it and require you to have a CERTIFIED of the CERTIFICATION of a COPIED document before they will accept it, make sure to have 10 RED stamps and shields approval all over it before bring it back and also sign by everyone else in the government :)
