Brad can still file the I-485 (and supporting forms) and submit the first notice of action/receipt notice from the I-130. He doesn't have to wait until the I-130 is approved. People who enter on a K3 with a still pending I-130 do that (submit the I-130 NOA1 with their I-485).

You really should have figured out what you were doing before you filed anything. You're here in the USA. What makes you think you need a visa? Visas are used to enter a country. What you need is legal resident status. This is achieved by filing an I-130 and I-485 together as well as the supporting documentation.

The process is very confusing and hard to understand - we did what we thought was right. Considering how many possibilities there are and how uninformative the USCIS site is I'd say we did pretty well understand what we thought was the right procedure.

Given the fact that I think you're right - how would you go about rectifying this and fixing the situation?

Don't feel bad if you did something wrong. It IS confusing and unclear. Alot of things seem to be contradictory too.

Agreed. The process is crazy, so don't feel bad  . What's important now is for you to NOT LEAVE the US at all (check Stacey's post) and send in the I-485 asap.

Good luck and ask away - a lot of folks here have answers and are quite supportive.

Thank you SO much everyone for your support and suggestions. We have finished filling all the supporting docs and 485 and are ready to send it in (just have to wait for the report of my medical exam which should be 100% fine)

Your advice helped a lot and calmed myself and my wife down!!

Current Status

Hey! that's what we're here for. I for one always try to be encouraging and nice, instead of giving people sh!t.- the process is humiliating and frustrating enough to then have us VJers kick each other in the head :bonk:

Good luck and keep us posted on your progress!!!

Len.
