Not yet married, now confuse!

Timeline

i have a gf in the philippines and we have 2 kids but we are not married

i am a legal permanent resident (LPR) since august 2006

i need some advice whether i go back and marry her and petition them

or wait for my Citizenship by 2011 and petition her as my fiance (k1)?

Which one is faster?

From what I understand, you can petition for her if you marry her first then file for a K3. LPR's cannot petition for a fiancée.

An LPR can petition for a Spouse (IR-1) but it gets a lower preference than a citizen of the USA, it probably will be faster to marry first and then file the petition than to wait until 2011 to file a K-1.

This is just my opinion, i always tell my husband-now-fiancee-before that it is easier and faster to file K1, if done properly. If you are good in understanding instructions, collating documents, all the paperwork, then do it yourself but if youre not then hire a lawyer. Goodluck to you.

Mar. 6, 2006 USC came back to Manila, Philippines - 2nd time

Mar. 13, 2006 USC's departure from Manila :-(

May 30, 2006 2nd I-129F got approved

You cannot file for K-1 or K-3 as an LPR. You can file for a visa for your children, and your fiancee, if the two of you get married first.

Your wife and children are in preference category 2A. Which currently has a priority date of 22-APR-02. So you can expect at least a 5 year wait. It may be easier and faster just to wait until you have citizenship. You will be able to file for your wife and children under K-3 and K-4.

Marriage or not, you'd be better off to wait until you are a citizen to file. An LPR has no use for an I-129F.

Which is why I stated "from what I understand" since I thought I had read this information somewhere. We all know how sometimes the wrong information is posted. My sincerest apologies for my post.

OK then Immigrant visa (F2A) Still will be quicker than waiting until 2011 to file for a K-1 and then 9 months beyond that.

Typically LPR Spouse visa takes 2-3 years for a visa number to come up, then a few months after that for the visa interview, less time than waiting the 4+ years for citizenship and K-1.

CSC is processing I-130 s for spouse of LPR from Jan 05, so just over 2 years to get a visa number at this point.

I would only ad that if the OP does get married, it would be worthwhile filing as a LPR in case Citizenship is delayed, the petition can always be upgraded.

IM GETTING KINDA CONFUSED OVER HERE

SO WHAT YOU SAYING IS "ITS FASTER TO WAIT MY CITIZENSHIP ON 2011 BEFORE I PETITION HER"?

OR

"MARRY HER NOW AND PETITION THEM"

AND I NEED TO KNOW WHAT TYPE OF FORM IT IS CALLED

1. Marry

2. Petition now as a LPR

3. If you are still waiting when you have naturalised you can upgrade your petition.

4. I-130. See guides, you just have to wait for a visa number otherwise it is pretty much the same as a IR-1.

There is the possibility that any Immigration Reform sic could do away with the wait, not something to bet on.
