Indirect concern regarding K1 application

Hi everyone. We are total newbies when it comes to this whole thing and are only at the stage of filling out the initial forms. However, I would like to ask some advice.

I'm currently in the UK and wish to enter the USA to marry and set up home with my partner. However, as I currently own my own home and am the Managing Director of a business, I am wanting to soon start to tie up my loose ends in preparation for the uprooting.

My question is will there be any problems with the processing of my application if I move address midway through my application, (i.e. sell my house and stay with relatives), and also resign the directorship of my company, (be bought out), and live from the proceeds of both the above until my application is processed?

As I would in effect by jobless and have no history at whatever address I moved to I'm concerned I could be jumping the gun and creating an issue for myself and my fiance.

I realise I have a full year to tie all the loose ends after the K1 is approved, but I don't want to delay our time apart any further than absolutely necessary and would want to be in a situation to be able to fly over to be with my love as soon as the K1 is approved. Having a house and a business is like an anchor round my neck that I wish to remove in advance if possible.

Thanks everyone for any advice you can give. I'm so glad I found this site, it's by far the most informative on the net I've come across.

Regards,

Darren.

First off as far as the job thing, no problem. They look at the Petitioners financial means and not the beneficiary. The biggest snag I could see is that the form asks for your address. They will use this address to send packet 3. If you have moved you want to be sure you get it. If you change your address with them later it may cause some minor delays as they access the file. If there is a way to use an address that will not change I think it might be better. All in all it should be no big deal.

Darren,

When you learn that the NVC has sent the approved petition to the consular section in London (they will send your fiancee a notice) you can notify the consulate to expect the petition and give them your current address that they should use to correspond with you.

Right, I too think your only worry is your address. I suggest you use a mailing address that will not change. Use a relative's address or get a mailbox at a mail forwarding service. In the US that would be something like the UPS Store or a Pak n' Mail etc. You rent a box at a business address. They'll forward your mail for you or you just pick it up.

I think your best bet is to use the address of a relative that you know wont be moving. Your can start the paperwork with your current address but once your papers move to NVC you can simply send them and email with your new address that being one of a relative or friend that you know wont be moving any time soon.

Yes, this is the correct change of address procedure but it doesn't always work. When it doesn't, there are sad delays. Avoidance is a more secure solution, IMO.

You're fine with both. People have moved and been fine. People have changed or ended jobs and been fine.

It sounds like you're financially secure (you have the option to prove your own ability to support yourself as well as having your fiancee fill out an affidavit of support on your behalf showing the US citizen can support you here) - so I wouldn't worry about either.

There are ways to update addresses at every step of the process (getting customer service on the phone to do THAT is easy - getting them to give answers about status is what is hard). And as mentioned, you can change your address on record with the NVC or with the London Embassy later.

The process altogether should take about 7 months (of course, it could take longer, but that's the average now) to get the approved K1 visa. Then you have 6 months to use the visa to enter the US. (After you enter, you have just 90 days to legally marry, or it's game-over.)

Doesn't seem like you'll have much trouble wrapping up your affairs and navigating the process at the same time.

Hi Darren,

You are in the same situation I was, I owned my own house and ran my own business.

I have recently sold my house and moved into rented accomodation and have wound up my business (a little earlier than I wanted to, but that was due to other issues).

My fiance phoned the NVC and told them my change of address, which they have added to the petition before it leaves for the London Embassy.

I also have redirected mail for 6 months (Royal Mail do this for a small fee), so if for any reason the address isnt changed it will be redirected to my new address anyway.

Your finances wont have any affect on the application, there have been those that have been declared bankrupt that obtained their K1 visa, its the petitioners finances they look at.

Any more questiond do feel free to ask and good luck in your journey.

Maggie

Hi again all. Thank you so much for your detailed and informative replies - and for pointing out my mistake about thinking I had a year to enter the US after the K1 application was approved - not that I intend to stay in the UK for a minute more than I have to anyway :) I've only been back in the UK for four days after visiting Laura again and it's not fun at all being so far apart, as I'm sure everyone has experience of on here.

Thanks especially to Maggie as you've pretty much explained what I was already planning and hoping I could do. I still am a little overwhelmed by everything that needs to be done, but I guess myself and Laura just need to break everything down into manageable chunks.

Right, I'm off to spend the bank holiday weekend decorating my spare room and bathroom and getting my house into a position to sell :)

Good luck to everyone and thanks again.

I know the exterior of the envelopes sent to the U.S. petitioner have a "Do Not Forward" stamp, meaning the mail cannot be redirected. I can't recall if the mail addressed to the beneficiary has this stamp, also, so you should probably look into that.
