To get married while there's pending K1 application?!?!

i saw Island_Princess recent post that she received her I130 & I129F approvals at the same time.

NVC Tracking-May 07 Approvals

Im just curious....

will it jeopardize or in any way will affect our K1 application if we're planning to get married in the Phils by this coming July?

according to VJ, our NOA2 might be adjucted by July 15,2007.

we just want to have this simple wedding ceremony since both our families are in the Phils. For sure you know how happy it will be - to celebrate this love with close friends & family.

any opinion will be highly appreciated...

Of course it will. Once you marry---if the K1 visa process is not complete and the visa issued--and it's not in the US, you nullify the K-1 and you must start all over again with a K-3 application.

I wish people would stop asking this question. If you want to get married before the visa process is complete, please file for a K-3 or a CR-1.

If you get married you're abandoning your K1 process and have to start over. K1 is a fiance visa to bring your fiance and marry in the US. If you're married you have to file for a different type of visa. The one you saw with the approvals for I129f and I130 probably was K3 and married.

My advice is to wait with the marriage...or you will have wasted time and money.

If you get married in the Philippines after your K1 is issued, it will be visa fraud to use the K-1 visa to enter the U.S.

If you want to get married with your families in the Philippines, cancel your K-1, get married, and then submit a petition for CR-1 and optionally K-3.

If you want to continue with the K-1, do not get married until after you arrive in the U.S.

If you're getting legally married it would affect the process, just like the above posters said.. you can not enter the US on a K-1 if you're already married.

Now.. I know this will start the same old debate, but this is MY OPINION and would be my legal advice if you were in my country. If this ceremony you're planning to have in your country IS NOT legally binding you'd be ok. I don't know how things work in yours though. In some countries, (like mine) in order for the marriage to be legally binding it requires to be registered at the civil register office and if it isn't, it's not a real marriage, ussually couples here have a civil marriage first and then a religious wedding, in the case that someone would have only the religious wedding, that person would NOT be considered legally married and her/his civil status would remain SINGLE, and would be able to enter the US on a K-1.. BUT as I said before I don't know how the civil law works in your country.

Just wait until it is through,there is no point giving up now it could only get you in trouble.Of course all of us are anxious about being with our loved ones but the Visa process is all about patience.

You could like others said here be in trouble if you get married right now,watch this rather interesting video of a couple that got married during their process(they got married in the US,but she had ended up having a ban for 10 years)

And that would SUCK

The I-129f referenced in that post is for a K-3 spousal visa--not a K-1 fiance(e) visa. That's why the I-130 is also mentioned. They had to file I-130 before they could file the I-129f for the K-3. Your circumstances are not the same. You did not file I-130. Your I-129f was for a fiancee, so the visa rules/uses are not the same.

Exactly! They filed I-130 because it is a requirement in order to file for K-3, the petitioner must submit the I-130 prior to submitting I-129F. Keep in mind that, for both types of visa, K-1 and K-3 you use the same form but the procedure and effects of each visa are completely different.

This other person was filing for K-3 that's why she submitted both forms! I-130 first and then I-129F and as a coincidence she got both approved almost at the same time!

OP, on the side of the message it will say which visa the person is applying for. Check this and if its not the one you are applying for, dont stress about what they are asking.

Please be more clear - are you planning to get married or are you planning to have a simple wedding ceremony? In many places a wedding ceremony does not necessarily create a marriage.

A marriage will cause you problems as a K1, a wedding ceremony may or may not depending on the law regarding marriage in the place where th ceremony takes place.
