Timeline

Is there a preferred order of assembly for the I-130 Original Submission package?

I plan to put tabs on the bottom of the pages but I suspect that the first thing they do is put the package in an order they are accustomed to processing. It would be nice to have it tabbed out in order for them.

If anyone knows I would appreciate it, unless I have an epiphany and some obvious logical order hits me I will try the basic order the items are referenced in the instructions and see how that looks.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

You are fine. But you don't need to submit 3 affidavits and photos as bonafide evidence. I am talking about the last two items of your list.

People do argue this but I'm interested in just what your friends swore to in their affidavits, considering you've been married less than 30 days at this point. The bonafides are for the relationship, not the wedding. You haven't had time to establish much of one as a married couple, that your official marriage certificate doesn't already cover. Those optional requirements are primarily in there for people who have lived together and established bank accounts etc.

Otherwise, just check your order against the link to the guides you were given but I like it.

Facts are cheap...knowing how to use them is precious...

Yeah, I am up in the air about the evidence part. I get the impression that they don't expect too much since we just got married less than a month ago. For the interview we will have much more and bring it all.

I have pictures of the wedding with family and friends (including the ones that gave the affidavits and also pics from xmas etc which I hope will at least establish us together (visually) 4 months ago. The wedding was a nice wedding so it is obvious there was some expense laid out, that should be good for something I would hope. It just occurred to me that I was thinking to send in a copy of the receipt for her, dare I say, EXPENSIVE :o wedding ring. Do you think that would help? I mean, it at least shows a financial commitment on my part, doesn't it?

(The pics are at a "Christmas in the Park" kind of thing in downtown so it is obviously Christmas and we are both in the picture and the picture was taken here in the states while she was visiting.) Of course, that is all mute because at this point they are asking for proof of a "bonified marriage" which that does not address at all and technically isn't even requested. Oh well, what more can I do.

When she comes to visit next month we will open a joint checking account which should come in handy later.

The I-130 form I have specifically asks for "Evidence that bonafides of your marriage" and gives examples of which I can only apply the "Affidavits". (Technically the pictures don't show an "ongoing" relationship, just the marriage.)

I believe it is a new requirement, the instructions I have are dated 01/05/07 with the same form revision.

I read somewhere that it should be possible to still send in the previous form (without the requirement) since the form download site does say previous forms are still accepted. (assuming they can still be found) At this point I am still more comfortable sending in the newest form. Am I wrong to think that these people are human? Then again, I am sure they follow things to the letter. Hmmm, that old form thing is starting to sound better all the time. Ha!

Well, there isn't much they can attest to as far as the marriage part. One is from her brother, one from a co-worker (and friend) of 16 years, and one from her best friend since childhood. I hope they help to establish the credibility of our relationship but they cannot really say much for an "ongoing" marriage.

Her brother has known me almost since the inception of the relationship, her co-worker has known me for about 4 months and has entertained us at his home and I have pictures etc. As far as her friend goes, when I am in Ecuador visiting her we usually spend an evening or two visiting her best friend. Of course, they have stated such in there affidavits along with the "we appear to be a genuine loving affectionate couple yada yada yada" kind of stuff.

Tell me, you say it is optional? That would be nice. If it is truly optional then there shouldn't be any harm in sending them should there? (Aside from maybe showing ignorance in following directions.) Ha!

Where does it say optional? It says NOTE:"In addition to the required documentation (listed in 1 through 4) above, you SHOULD (my emphasis) submit one or more of the following types of documentation that may show evidence that bonafides of your marriage."

Am I to read: "In addition to the REQUIRED documentation" (listed in 1 through 4)" to mean that unless "listed in 1 through 4" it is NOT required?

I mean, I know that they know that I can't possibly have much evidence that bonafides my marriage but then again, I want to make sure that I provide everything that they want in case they don't have the lattitude to waive something like that if it is technically required.

I went and had my husband added to the title of my car. When the new title came, I made a photocopy of it and sent it in because I thought that would be easiest route to go.

I went and had my husband added to the title of my car. When the new title came, I made a photocopy of it and sent it in because I thought that would be easiest route to go.

That's not a bad idea but I want to send it out asap and the way the CA DMV works that could take awhile. :-(

Hey, do you know if the "bonafide marriage" information is required? Pushbrk implied that it wasn't in a previous reply to this thread but I never heard back from him on what he was basing that on.

Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

I wanted to add that the I-130 I filled out and sent in states in the instructions that :

NOTE: In addition to the required documentation listed in 1)through 4) above, you should submit one or more of thefollowing types of documentation that may evidence that bonafides of your marriage:

1) Documentation showing joint ownership or property; or

2) A lease showing joint tenancy of a common residence; or

3) Documentation showing co-mingling of financialresources; or

4) Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5) Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6) Any other relevant documentation to establish that thereis an ongoing marital union.

You are fine. But you don't need to submit 3 affidavits and photos as bonafide evidence. I am talking about the last two items of your list.

People do argue this but I'm interested in just what your friends swore to in their affidavits, considering you've been married less than 30 days at this point. The bonafides are for the relationship, not the wedding. You haven't had time to establish much of one as a married couple, that your official marriage certificate doesn't already cover. Those optional requirements are primarily in there for people who have lived together and established bank accounts etc.

It states in the instructions of the I-130 that in addition to the required documentation, the petitioner should provide one or more types of documentation showing evidence of the bonafides of the marriage.

Otherwise, just check your order against the link to the guides you were given but I like it.

Well, there isn't much they can attest to as far as the marriage part. One is from her brother, one from a co-worker (and friend) of 16 years, and one from her best friend since childhood. I hope they help to establish the credibility of our relationship but they cannot really say much for an "ongoing" marriage.

Her brother has known me almost since the inception of the relationship, her co-worker has known me for about 4 months and has entertained us at his home and I have pictures etc. As far as her friend goes, when I am in Ecuador visiting her we usually spend an evening or two visiting her best friend. Of course, they have stated such in there affidavits along with the "we appear to be a genuine loving affectionate couple yada yada yada" kind of stuff.

Tell me, you say it is optional? That would be nice. If it is truly optional then there shouldn't be any harm in sending them should there? (Aside from maybe showing ignorance in following directions.) Ha!

Am I to read: "In addition to the REQUIRED documentation" (listed in 1 through 4)" to mean that unless "listed in 1 through 4" it is NOT required?

I mean, I know that they know that I can't possibly have much evidence that bonafides my marriage but then again, I want to make sure that I provide everything that they want in case they don't have the lattitude to waive something like that if it is technically required.

I have read the VJ guide many times but nothing indicates it is order specific? Thanks for the vote of confidence on the order, I am not stressing on it too much I just wanted the tabs to be nice and neat.

People who have never lived together are being approved in droves without any of the "should submit one or more" documents. The I-130 is also commonly used for adjusting status, for people who married in the US and live together in a bonafide marriage, people with sham marriages purely to avoid deportation, Direct Consular filings which by definition are people who live together and those like many of us, who have never lived together in the same country. The USCIS understands that in those circumstances the marriage certificate is all that is available. They also know that before any visa is issued, a Consular Officer will conduct an interview and directly examine the required proof of an ongoing marital relationship. This is commonly demonstrated with communication evidence and additional visits, though additional visits are not a requirement.

No, I don't think it would hurt to submit the affidavits, particularly from people who have made at least some observation of the evolution of the relationship. What seems to need constant clarification is that any affidavits are to swear to "the bona fides of the marital relationship". This is most often referred to as the "marriage". Attesting to attending a wedding and/or reception is not what is being requested. It's not the "wedding" that is of concern. The marriage certificate attests to that quite well. Meaningful affidavits can help. Affidavits from virtual strangers who only witnessed a ceremony and attended a party could actually raise suspicions or at least provide a chuckle.

Facts are cheap...knowing how to use them is precious...
