putting the CR1 on hold

Timeline

has anyone done it and can tell me more? i contacted USCIS frankfurt but they keep asking more questions...

the situation is:

we waited 9 months already and still dont have an approval. therefore we had to take a decision about our future (i got a new and very good job, hubby was unemployed after leaving the army... and one thing led to another...). so hubby now came to germany and we plan staying for 2 years.

is it possible to put the CR1 on hold and reopen the case in a year?

or is it possible to be very slow in answering all letters from NVC so we dont have to put it on hold?

One the I-130 is approved it's good for one year. You can take the slow route but 2 yrs is still to long. If he is not working he will need a co-sponsor so you might want to rethink just withdrawing your petition and start over at the right time.

I think that's just something you may have to deal with; if you're going to stay in Germany for 2 more years, you're not ready to apply for the immigrant visa. (F)

well those two years arent fixed so it could be less. depending on how fast hubby gets his degree (he is back in school). also once the visa is issued, i have 6 months to enter the US. and also the case needs some time to go from the NVC to the embassy here. and they need some time to give me an interview date, which i actually can postpone once.

so there is a slight chance...

no decision taken yet though

I think that's just something you may have to deal with; if you're going to stay in Germany for 2 more years, you're not ready to apply for the immigrant visa. (F)

im not sure if you actually can tell me if or if not im ready to leave. i was when we send the petition... it took forever and we still have no approval. what is so wrong about looking in other directions now?

it is not that germany is a third world country that i just try to get out anyhow. believe me there are certain things that are better here (the whole social system for example). but i also love the US and i want to live there because we have lots more opportunities once my hubby is done with school. why should i risk now to end up in a trailer park and not knowing how the next week will be?

and just to say it: the USCIS offers to put a visa on hold! the question is just what the circumstances have to be like.

You said you were going to stay in Germany 2 more years. It's not time yet to apply for the visa...this is what I mean by 'ready'.

it is not that germany is a third world country that i just try to get out anyhow. believe me there are certain things that are better here (the whole social system for example). but i also love the US and i want to live there because we have lots more opportunities once my hubby is done with school. why should i risk now to end up in a trailer park and not knowing how the next week will be?

I didn't say anything bad about Germany. I've never even been there.

Yes, we looked into this ourselves; our circumstances didn't qualify and I'm not sure yours will either. It can't hurt to check it out, though; the worst they can do is say no.

Hi,

I am not a very experienced VJer, but it seems to me:

you don't have I-130 approved yet. Once it is, it is good for 1 year - I would guess it means you should have your interview within 1 year from I-130 issuance? You CAN reschedule embassy interview appointments. Once the CR1/IR1 is issued, you have 6 months to enter US.

Sooo, if your I-130 is approved tomorrow, you already have 18 months. AND there is nothing to stop you from going to US for a week to "activate" your greencard and go back to Germany for another 6 months to finish your work's obligations.

So if you ask me, I think you are doing just fine! :devil: :devil:

On the other hand, you WILL need cosponsors if your spouse does not have income, or will not have US source income. Which however would also be the case if you withdrew your petition and applied later.

Also consider that if you withdrew and re-applied, DCF may be available to you. And that is much faster.

When there are consequences to the actions you choose, you have to be willing to accept those consequences if you choose that action. You have choices to make. If you don't like the consequences of those choices, you may have to alter your plans. Not liking the answer to your questions doesn't alter reality.
