state aid question

hey all,

i have a question that some may be able to help with

im sotishand looking to move to the states to be with my fioncee, she is pregnant and is on state aid.

now she is worried that when i get there and we marry she will no longer qualify for that aid, so then no med bills and everything will be helped with, also the money she gets every month.

allso the foodstamps, now when i find work it wont be a problem, but untill then can anyone give me an idea how that will work.

i do have a sponser but dont want him to end up responsable for us and the 2 kids we will have.

yep im fully aware that i dont qualify,

she wont be sponsering me, a freind of ours is, so theat part is sorted as far is i am aware from reading up on this, just it says nothing about what she gets from the fact that she recieves disability and other help from the govermant.

This is an interesting situation. I would really like to hear the outcome. I would assume she has a co-sponsor then. After arrival and marriage, if you get a job it will certainly have an affect on her qualifications for public aid! That is the interesting part because the financial document says she will be responsible for you so you CAN'T draw public assistance! Hummmmm

well thats the thing, he wont be co sponser, he will be the only sponser, but that i think is by they by, with a baby on the way and no garente of a timeline when i will be able to work, she cant affored to loose all that as soon as we get married.

just one more worry, and all before we even file:(

How far along is she? Chances are she will have had the baby before then anyway, though you do need to consider how the 2 of you will take care of the pediatric expenses after the baby if she does not qualify for medical.

Also, if she is your fiance she has to sponsor you and if she does not qualify (which if she is on public assistance she wont) then you use a co-sponsor.

I do not know if your immigration precludes her from receiving public assistance or not. On the one hand it seems as a US citizen she should have access if she does not have high enough income. On the other hand she is signing that she will not allow you to be a public charge and public assistance generally puts the whole family together on the application.

ok im confused now,

i may be wrong but when i looked into this a few weeks ago everything i read on the matter said that the person filing for my imigration, I.E. my fioncee, doesnt need to be the sponser, and that anyone else can do it as long as they meet the required limits.

now im even more confused:(

Your fiance will have to fill out an affidavit of support. If her income is not sufficient, then a co-sponsor is needed.

If she is on assistance and you marry. if she still qualifies for the assistance. she will receive it. You will not be elegible for it. However she is.

I have a friend that was going tru similar situation. Family services stated that she would still be eligible the income you get is seperated.. since you are still in process of residency... you wont have your green card yet.. .. therefore they seperate it.

She may wish to ask her worker of the details. But as far as foodstamps or medical it is counted for her. not giving you the benefit so .. therefore benefits for just her and baby .. not you her and baby.. household size for benefits is different..
