DS-3032 Choice of Agent form

Timeline

I recently received my case number from the NVC. I have read somewhere that I will not receive this form since I have a lawyer. But would my wife receive this form in India? Would the lawyer I hired in U.S. also function as her agent? I am confused. Thanks in advance.

FORM I-130 PROCESS

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

If your lawyer filled out I-130 form for you, then yes, he/she will be your choice of agent. You mmight want to call NVC and comfirm it.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

The way I understand it the DS-3032 goes to the person who is to receive the visa so they can identify who should receive any letters from the NVC. This can be the lawyer if you choose or you but I would think if you are paying the lawyer he should be the one named on the DS-3032.

If you want to be efficient and skip the lawyer, you can change the agent of choice by email and make it yourself, the petitioner. It's entirely up to you. Actually the email needs to go to NVC from the beneficiary but I did that by creating a US yahoo address in my wife's name and sending the email myself.

Facts are cheap...knowing how to use them is precious...

I will be facing this issue as well. We have full legal representation and also submitted a completed Form G-28 along with our I-130 petition. We do not want our lawyer being the Agent of Choice, we definitely want me (the petitioner) to be the Agent of Choice.

pushbrk - You had submitted a G-28 with the I-130 and emailed the NVC asking for the petitioner (you) to be the Agent of Choice instead? I want to make double sure that this is allowed even though we have a lawyer.
