How do I know if I need a Co-Sponser?

Hi VJ'ers,

How do you know when you need a co-sponser? I have been living with my fiancee in Mexico since Septmeber, therefore I don't have an American job with American paystubs. However, I have about $5000 USD saved in my American bank account, plus my fiancee has a Mexican HSBC account with about $1000 USD in it. I also get some dividend income from some stocks that I own (not much) but ... is that enough, or do we still need a co-sponder? Where can the guidelines be found for this? I've read the I-134 form but it doesn't say much.

So then that poses this question: do I fill out the Affidavit of support form, as well as the co-sponder (my mother)? So we have TWO I-134's? And, will they accept a faxed copy from the US for my mom's copy, since I don't have access to the original?

From the sounds of it, you need a co-sponsor.

And yes, your mother need to fill out another I-134 and it should be original.

For the I-134, you need to make 100% of the poverty guideline which can be found here. The present poverty guideline for a household of two is $13,690, and it sounds like you don't even meet that.

Even if you could find a way to meet that, remember you'll have to come up with 125% for adjusting his status once you are married - in which case, it definitely sounds like you need a co-sponsor.

You will have two, but something is telling me that they won't accept a faxed copy, they need original signatures. Could your mother mail it to you? Both my mother and I live in the states, but 1300 miles away so that's what I had her do. It would cost your mother a lot more than it did for mine, but such is the cost of immigration.

As far as you not having an American job with American paystubs - did you have a Mexican job with Mexican paystubs? If so, and you made enough to be required to file, make sure you've filed your 2006 taxes, and living in another country doesn't exempt you from filing in and of itself. (You probably did since you lived in the US for the first 9 months of the year, but I'm just trying to cover all the bases.)

You should start by reading the financial requirements for the consulate in Ciudad Juarez. They don't require the I-134 although most K1 petitioners do fill it out simply because it's an easy way to provide the informaiton. That said, you still need to make the minimum amount in order to support your fiance. 2007 poverty guidelines (http://www.uscis.gov/files/form/I-864P.pdf) indicate that you need a sponsor. I-134s have to be notarized so your mother would have to fed ex it to you. Take a look through the Juarez thread in the Foreign embassy forum - there is information there from people who have used sponsors.
