CRI denied: reasons that no proof of relationship

Hi,

A friend called me this morning to seek advise about the CRI,since I just succesfully completed my process not long ago. He narrated the story that his wife was denied a CRI visa at the embassy interview because of the following reasons: 1. no proof of relationship,because she was asked about the names of the her husbands two children which she couldn't recall their names and gender. 2. she paniced alot and the consular suspected a fishy thing. Otherwise, the photos,emails etc to establish the relationship was fine.

The denial letter they gave her at the interview said in part that,they were sending the case to the review board for the final verdit. What can he do now? Any advise?

WOW....maybe she was nervous because of all this stress with the visa and they denied her? I am really sorry to hear that :o

05/29/2007 Interview at 7.30 a.m. APPROVED Thank you, God!

06/01/2007 Visa arrived !

06/03/2007 Mayday on the plane POE Cincinnati

Living in Maryland

06/21/2007 Welcome Notice from USCIS

06/29/2007 Applied for SSN at the local Office

07/07/2007 Green Card arrived

07/09/2007 Another 2 Welcome Letters from USCIS...God, they really love me! :D

07/20/2007 Social Security Card arrived

Living@working in Maryland :)

01/18/2009 PCS-ing to Stuttgart Germany

Feb 2009 Received letter from VSC to start removing conditions.

Getting ready the packet for Removing Conditions I-751

03/12/2009 Mailed the I-751 packet to Vermont Service Center

It is important to get the terminology correct. This sounds like she given a notice of intent to deny and that the case will be sent back to the USCIS with that recommendation. The prudent thing to do at this point is to hire a local attorney in her country to deal directly with the consulate in order to resolve the issue there before the case file is returned to the US. This is absolutely critical.

If the file is returned to the USA. the most likely result will be a denial that will be expensive and time consuming to overcome, if at all.

Facts are cheap...knowing how to use them is precious...

I can not understand how she could not have remembered the children's names

and gender and it does not surprise me that it was send back because of that.

Such information is vital. There is a special returned petitions thread here, I hope someone will link you up to it.

They should file an appeal with the USCIS Benefits center ASAP. The case will be reviewed an re-opened. Seek a lawyer's advice though.
