Hi,

we filed our I-130 march 21 to Nebraska that sent it to CSC. They received it March 23 (tracked the package through USPS). They cashed the postal money order enclosed but we never received the case number. My wife tried to call and they said that the waiting time is about 4 weeks. Now they are saying it could even be longer just to receive the NOA1. We plan to file the I-129F asap and this waiting is just making everything longer!

I noticed that everybody on this forum received the NOA1 within days... is it normal to have to wait so long? Any suggestions on what to do? We should receive within a couple of days the postal money order as proof they cashed it, should we try to fax it somewhere?

Is anybody aware of any official timeline?

check our timeline, same thing happened to us, we sent to nebraska and it got transfered to CSC, but we got the hard copy back to us in 4 days..

I really would of thought you would have got yours by now, but if they say 4 weeks, start kicking up a fuss with the uscis after the 4 weeks have passed.

I hope it comes through for you, its not much but a really good feeling to get it because you know things are happening for you.

It is fairly common problem in the last few months for USCIS to not send NOA 1 for I-130. I filed my I130 in beginning of February and it was recently approved but I never received my NOA1. I waited for about 6 weeks trying to get NOA1 but then decided to file I129F with evidence of filing I130. This is the reason my I129F is still pending even though I130 has been approved. It will not be helpful to contact USCIS to get the NOA1. You will get a different excuse each time when you call them. I received my case number from the back of the check that I sent to USCIS but I don't know how that would work for money order. So my suggestion would be to file I129F as soon as possible and include some evidence of filing I130.

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

Do you think a copy of the receipt of the money order and a copy of the receipt of the package would be an evidence good enough. If our I-129F get stock like yours it doesn't really do me any good to try it... do you guys think the above suggested evidence could be accepted?

By the way, when my wife calls them they keep saying that our case is not in the system yet. Do you think that it is still processed and we can eventually get an NOA2 even if we are not in the system yet?

They are just making stuff up by telling you that the case is not in their system. If the I130 was received on March 23 and they cashed the money order, it has to be in the system. I would send them the copies of all the evidence you have. This will at least get the I129 process started. And then you can keeping calling USCIS in the hopes that they will send you NOA1. If they need more evidence of filing I130, you can hopefully send them later. More likely than not, they will not ask you for NOA1 for I130. I have many people on this forum who send their I129F with some evidence of filing I130 and they have no problem.

A copy of the money order, a copy of the filled I-130 (just the 2 pages) might be enough. NOA1 isn't the only thing meeting the "evidence" requirement.

A copy of the money order, a copy of the filled I-130 (just the 2 pages) might be enough. NOA1 isn't the only thing meeting the "evidence" requirement.

The money order copy with the case number stamped on it is evidence of filing the I-130. Also, now that the two cases are likely to end up at the same service center anyway, they'll have the actual case file as evidence. Yes, I would file the I-129F as soon as possible (with the money order copy and case number) unless you're just not in a hurry.

Facts are cheap...knowing how to use them is precious...

Just wanted you to know my husband and I are having the exact same problem. Our cheque was cashed Mar 15. They told us the wait time was 4 weeks and we weren't in the system yet. Same thing for the next call. I then called myself using skype (the 1-800 doesn't work in Canada, but for some reason skype does) last week and spoke to a really nice guy. He said because I was not the petitioner he couldn't give me any information, but he did go into the system to look us up and we weren't in it yet. I saw that another person said they were lying, but I am positive he looked. He told us to try back in two weeks, which we will. We decided that if there is nothing at that point we will use the infopass and my husband will go in and talk to someone personally. As well, another VJ member wrote to get her NOA1 and she just received a letter stating that they received her request...but no NOA1 (mononoke28). There should be a number on the back of your money order which you may be able to use to track your file in the website.

If your case in not in the system yet then I don't know what to tell you. What I find odd is that you already have a receipt # so that should indicate that you should be in the system, or else how would they have generated that number in the first place?

You can check out my timeline and see what I've had to go through with CSC to mail me the NOA1 for the I-130. It's been almost 3 months and I still don't have it, BUT they did assure me that I was in the system. :huh:

I don't have a receipt number, I wish I did, I have the receipt from the USPS because I sent the package with express mail and I have the post money order because I asked the post office to track down the payment to see if they cashed it. I don't have any receipt number from USCIS... I wish I did... I don't understand why everybodyelse gets it within days. I'll have my wife try to call them again, she said they are really rude to her though.

Well, they say to call 30 days after the petition is in the system. You mailed it out on 03/21 so that's barely 30 days since you sent it, add another week for when they cashed the money order for it to be in the system. Man, I don't know... these people are just so messed up.

I think it's a good idea that your wife keeps calling them, maybe every other day to find out what's happened. The thing is, you want to give them enough time to put your info in the system but at the same time you don't want to wait a long time to find out they've lost it.
