Living Apart when removing conditions????

Hello All

I am worrying about this very far ahead of time but I think its only wise as it could affect our plans in a big way. So I am on an H1-B visa, my fiancee (the USC) and I are getting married in June and then moving to Baltimore where we plan to apply for AOS for my green card. So now based on what I can tell assuming things go well, we can hope to have the green card sometime by June of next year (at the earliest at least).

Now my question is the following. MY fiancee (then wife) will continue to work in Baltimore, and it may turn out that I have to move to either New York or Boston to go to school. If this is the case then the removing of conditions two years after the green card will happen right as we are about to end our period of living apart. How problematic will this be? Some thing that will be true in our situation: plenty of Amtrak tickets for visits, there will probably be a student loan account for me on which she is the co-signor, and we might be able to get affidavits from friends relatives etc.

How bad is our case going to look when it comes time ot removing conditions i..e that we had been livingapart for the entire two years after getting my green card?

I'm asking this right now, as if this is going to be a huge issue I'd be tempted to try to get my green card through employment instead even though it is more expensive. I think I might qualify for the EB1 category, and I dont know if there is much to lose besides the effort and cost.

Sep 1, 2007: Received NOA1 (Dated Aug 29)

Nov 25, 2007: Received notice for interview in Baltimore, MD (No touches, nothing online to date)

Jan 22, 2008: Interview in Baltimore, MD. Went well.

Jan 29, 2008: Can finally track I-130 online. Approved.

Jan 31, 2008: Email I-485 "Card production ordered"

Feb 5, 2008: Another email I-485 "Card production ordered"

Feb 7, 2008: Received I-130 approval and I-485 "Welcome to America Letter" in snail mail

Feb 7, 2008: Email I-485 "Approval notice mailed"

Feb 9, 2008: GC in hand....... (Done with USCIS for a few months) YAYY!!!!!!

Oct 22, 2009: Process starts again. Going to mail I-751 to VSC

Jan 26, 2010: Notice of Approval and Card Production for 10-year GC

Feb 3, 2010: 10-Year GC Received

The bottom line is that you and your wife will have to submit proof of a conjugal relationship and joined lives. Even though you will be living apart, surely you will have conjugal visits, trips together, etc. Will both of you be renting or will you be buying a house in both your names) that will serve as the primary home? You will have to get very creative in putting together proof that you and your wife are truly married and this separation is temporary.

09/02/08: Received NOA...........Priority date: 08/20/08

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

It's not an automatic Bad Thing--not worth wrangling with the EB Green Card app... You might go to this forum: http://britishexpats.com/forum/forumdispla...prune=&f=35 and read about Noorah101's situation--she & her spouse have been living apart like you describe. Granted, they're just now filing the I-751, but it's not been an issue thru their AOS etc.

I'd think the context is very important. Save evidence of your visits and co-mingle your lives in other ways.
