No NOA1 - it has been over 45 days.

Okay. I am new so I hope I am doing this right.

Here is my situation. We were going to go the K3 route, but have yet to receive the NOA1. We sent it in Mar 1st to the Nebraska office (as instructed on the form). As far as my husband can make out from the fax of the money order sent from the bank (it was scanned and then destroyed so no original to look at...now wish we had used a personal cheque) it looks like it was cashed by the California office.

So my question is - do we abandon the K3 route and just go CR1 or wait until we get an NOA1? Any advice would be great. My husband just wants me back in the US asap (of course) and being him thought because I was Canadian they would just hand me a greencard at the border (yes, we really were that foolishly simple).

03/01/07 Mailed I-130 priority post to Nebraska.

06/19/07 Approved!!!

07/10/07 NVC assigned case #.

10/25/07 NVC Case Complete!!!!

01/22/08 Original Monreal interview- requested to reschedule, told 3-4 month wait.

04/17/08 Interview in Montreal

04/21/08 Received VISA package

06/24/08 Crossed border

07/26/08 Received conditional greencard

07/28/08 Received SSN in mail (went down and applied in person 07/14/08)

08/11/08 Infopass appointment to request 10yr greencard instead of conditional. Mailed out 1-90 with support.

09/25/08 Received case # for I-90

02/17/09 Received 10yr greencard!!! WOOHOO

I was on the same boat as you. Planned to file for a K-3 visa but never received the NOA1 for the I-130. There are some members in here who filed the I-129F without a copy of the NOA1 but they also had the receipt # written on the cover letter. I'm not sure if that will be ok with USCIS though. You can do a search on the subject to find out how they pulled it off.

As for which visa to pursue, it's really a personal decision. I kind of made out the # that was written on my check (it should start with WAC# by the way) and when I called USCIS 30 days later, they gave me a different #, but I still haven't received my NOA1. Because of this, my husband and I decided to just go with the flow and hope that USCIS will approve our I-130 since we had to wait for so long for the NOA1 anyway. In the long run I think it's a better visa option since we won't have to deal with AOS or EAD when he gets here. But if you and your husband want to be together ASAP, you should look into finding a way to file the I-129F. I also suggest you look for members who are also from Canada and see how long it took their petitions to be processed, it also depends on the embassy you're going throgh.

My husband called USCIS today. They still cannot find us in the system. We have made an infopass appointment for Friday....I now understand why this process makes people depressed.
