and we are also planning to include her cousin's income (like $45,000) to my CR1 application as a co-sponsor. So it would be my husband,mom, and his cousin's income plus their property.

In regards to his father pension, they didnt include it cuz they didnt know if they could.

sounds like all you need is your cousin to sign to be the co sponsor. resubmit it to the consulate.

Yes you are right! his cousin is very much willing to help. So u think we could try it soon eventhough my husband doesnt have a job yet or just wait for husband to have a part time job / full time job and include cousin's income?!

Doesn't appear to be a big issue at all. The financial requirements are very clear and your husband should have understood these BEFORE the interview.

Get a co-sponsor. Re-submit the documents.

The anecdotal evidence coming out of the consulate in the Philippines is that the officers there are so strict about sponsorship that some people believe they do not allow any alternate sponsor, only the petitioner can sponsor. I don't believe that this is true, but I do believe that acceptable sponsors need to have very close ties or the consulate will deem them to be not reliable. A friend who lives on the opposite side of the USA, for example, would clearly be a bad choice. An immediate family member such as parents who live in the same household should be an acceptable choice (assuming that they have the money). A cousin who lives where(?) would fall in between, and may or may not be acceptable depending on what the complete picture of the situation looks like. Simply having enough money is not the whole picture.

Yes you are right! his cousin is very much willing to help. So u think we could try it soon eventhough my husband doesnt have a job yet or just wait for husband to have a part time job / full time job and include cousin's income?!

It is a first cousin of my husband. Actually, they are really close to each other, like sometimes my husband is confiding some problems to her. I even talked to her cousin tina through email. They both live in L.A, i think it's like 30mins away from my husband's house.

It's a positive that the cousin is a close relative, a close confidant, and lives close by. Be sure that these things are well demonstrated should you decide to offer this person as the sponsor.

my husband contacted a free lawyer (A white guy) And Told that it sounds like his cousin is a very good try. Free lawyer says we should try to document the relationship like, how they ARE REALLY RELATED BY BLOOD (Birth certifacate...etc) and a written note from her saying how close she is to us and how or why she's willing to help and how the CO can be assured of that...etc.

What the free lawyer told you is pretty much the same thing that I told you, except that he did give you some specific ideas for documentation - family birth certificates, and an affidavit attesting to their social relationship.

the cousin as a co-sponsor does sound promising but she does not live with them. i know one couple who had to use his brother as his co-sponsor but he lived with his brother so it was ok. the cousin does not live in the same household...so it's so easy to assume that although she is making that much money, she is not going to contributed to your husband's household income.

your husband getting a part-time job would probably be an even better solution. i know it's hard to go to school and work at the same time but it's definitely doable. i did that all four years of college and i know many others who did...so i'm sure he can do it too. even if he lands a minimum wage job (in CA it's now $7.50/hr) and work at least 20 hrs or so...it should be enough to add to the entire household earnings. if he tries to apply for jobs now...he can use his current earnings and paystubs as proof. anyways, just a thought.

well, here's my 2 cents...i also think your husband should get at least a PT job since the CR1 sponsorship requirements is more strict. From what i read, your husband will be the primary sponsor so he MUST be making some kind of money or have a big bank account and the joint sponsor or co sponsor is only there as additional income to fill any gap.

It's too late to go back in time to the K3 interview but don't mess it up this time for the CR1. Be more prepared. If there's a way to re-open the K3 interview with the consulate, then you should have his father's pension and cousin included as well.. though the cousin is enough for all three of you... good luck..
