Hi y'all,

I have an interview for naturalization next week. I wanted to know if my divorce can cause any problem. In 2009 I married my first husband, he came to my country and we got married. In 12/2011 I was granted a visa to enter the USA. Since we've been married for 2 years before entering the USA I was sent a Permanent residents card. The month I lived with my first husband showed me that he wasn't the person I thought he was. He was cheating on me and have a kid while I was in my country. I moved out of his house started working but I couldn't afford rent in moved to another state where my sister and her husband live. Year later in 7/ 2013 I filled for divorce, when I met this guy that I married a year later in 7/2014, we currently have a kid his 2 years. 

 

Note: both my former and current husband are USC.

 

Would be complication during my interview?  Anybody was in same situation? Please help

I see it has been 3 years since your second marriage, which is enough to qualify for citizenship petition. Just bring all the paperwork related to marriages and divorces.
I wonder if you filed on a 3-year rule or 5 year rule.
 

Thanks for replying to my thread.I applied after being in the country for 5 years. But the appointment letter was stating "naturalization based on marriage to USC" 

But my second marriage will be 3 years in july. I was confused because I received my green card based on my first marriage not the second.

^ past marriage won't really have anything to do with it.

 

OP, all you need to do is prove you're still in the marriage with your petitioning spouse, otherwise you'll need to wait 2 more years before you can naturalize, as at that point a marriage won't matter at all anymore for it.

But my second marriage will be 3 years in july. I was confused because I received my green card based on my first marriage not the second.

 

On the application, for Part 1. Information about your eligibility, did you choose 1. Have been a PR of the US for at least 5 years? or 2. Have been a PR of the US for at least 3 years and have been married to and living with the same USC spouse for at least 3 years?

 

You are qualified to apply under 5 year rule. If you chose 1, I'm not sure why the appointment letter said "naturalization based on marriage to USC". Because you've been a PR since 12/2011, your past and current marriages don't have anything to do with your naturalization.

Have they changed the interview letter format recently? They used to not state the type of application you applied, my letter looked like this  (found picture on internet). Only part it states naturalization based on 3 year rule is down in the middle "If applying for naturalization as the spouse of a United States Citizen..." Does yours look any different?

No my letter looks exactly like this one. So it's not based on marriage to a usc? Is the interview will be different since I was permanent resident for 5 years?

From what I heard, it'll be easier. But personally, my interview was easy too (I applied under 3 year rule). 

 

Don't stress out too much about this. You'll be fine. Just answer truthfully.

Hello:

 

Don't worry about your previous marriage. You might asked about it like when did you get divorce? Why? but thats to make sure you entered that marriage in good faith not only for a green card. 

If you applied based on 5 years of residency than you don't have to worry about neither marriages but it's a good idea to take proof of bonafide relationship just in case. 

Your interview should be an easy one compared to 3 years residency ( meaning less proof needed). I applied for naturalization 3 years ago and it was based on 3 years residency and it was so easy. 

 

Don't stress it out, you will be fine.

As kim&jos stated if you selected option 1 have you been a PR of the US for 5 years then that would be the basis of your interview, so look at what you had selected. If you look at other folks who filed with the 5 year rule they didn't have to show a lot of evidence if any. As others said just carry evidence around your marriages being legit, definitely your divorce decree. All the best

If you applied under 5-year rule, ideally you should be fine.....

I had my interview an hour ago, it was smooth, the officer was very nice and friendly.

She was surprised why I never changed my last name. And why I left my first husband. 

She didn't ask to see any documents for anything. Then i did the civic test and passed it along with the written test. She told me my application was recommended for approval.

Anybody knows when should I expect the oath ceremony letter?
