I 134 question

We're not to the I 134 yet, but my mom and uncle kind of got me paranoid yesterday. My cousin went through the whole fiance visa process too and she and my uncle, and now my mom, are convinced that I will have trouble proving my ability to support my fiance because I have only been out of college one year. One of my tax returns will essencially show no income. I've only been at my current job since August but make well above the 125% poverty level requirement and will be employed there next year as well. Should I be as concerned as they are? Are they looking more at past income or future prospectives? Also, I'm going to have my parents co-sponsor, so that should help, right?

Yes you should be concerned. As far as the K-1 visa is concerned, each consulate is different in what they consider what is sufficient to support your fiance. That has been proven by the stories posted here. I do not know the history of the Mexican consulate.

However, you will absolutly need to prove the income for the AOS. If your situation and job are good and stable like you say, a co-sponser should not be hard to find and I suggest you do it.

I am in the same position you are except I have had no income for the past 3 years because of school. I make well above the 125% poverty level and my employer will sign a paper stating my position, full-time status, ,and salary. I will also have a co-sponsor just to be prepared in case the consulate requests more. You will be ok.

his job stability has no bearing on his ability to find a co sponsor

they are looking for your ability to support your fiance in the future, so it may not matter that you only worked for a year just that you can prove that you are highly likely to remain on that same income

The I-864 is stricter on income requirements than the I-134...so stability may be an issue. It depends on the consulate. All areas of income requirement should be considered, whether they are looked at or not.

Don't be silly, job stability has EVERYTHING to do with finding a co-sponser. Would you sponser someone you thought would not be able to support their mate?

AOS has everything to do with past and not future earnings. Do not be fooled by these responses.

and about a co sponsor, your still not making any sense to me. he isnt going around asking people to be a co sponsor on the grounds he has a secure job, as if he did he wouldnt need one in the first place thus defeating the object of looking for 1 in the first place, he mentioned his parents ehlping him out

I am in the same boat as you. I make well above the necessary amount now, but only started the job in September. I had my mom co-sponsor for both the I-134 and the I-864 with the understanding that she would never actually need to help us (I mean she knows she is legally responsible to and would certainly help us if we needed it)

Its possible that this was not necessary, but I figured I didn't want to take the chance. I would get a co-sponsor just to save later trouble for yourself.
