question about when my fiance' can come into the usa again

My fiance' was in the usa from November 09 2006- February 02 2007 he came in on a the visa waiver program. When can he legally come back to the us and stay for 3 months again?

I don't think he has to wait a certain amount of time before returning to the U.S., but he should be sure to bring proof of ties to his home country. That way he can show intent to return home.

He can return whenever he wants, but as you know, the VWP is no guarantee of entry. He should bring evidence of ties to his home country, escpecially if his visits are frequent.

When he comes to a US POE and a CBP officer grants him entry.

What would be his purpose for the visit? To live with you while waiting to get his visa? Not likely to get him in.

With regard to 'ties to the home country', he can't have many if he can spend 6 of 7 months in the USA and only 1 of the 7 in his own country.
