RFE from CSC

Timeline

We received RFE this week. We thought we missed something but to our surprise, this is what our notice says...

"Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition..."

This is really suprising because we really have a lot of proofs to this. We sent 10 digital photos of us together, his photocopied passport stamped pages, a copy of DUTY FREE shopping card with his name on it, a copy of his credit card statements that we went to different places here. (MANILA INTERCON, Coco Beach in Puerto Gallera, Tony Roma's)

So when my boyriend called up the CSC just today, he was told that maybe our proofs got lost since our papers are being processed by different people. We waited for more than 3 months for the NOA2 and this is what we only got? RFE because they lost some of our papers? I hope there's something we can do about this... I wish someone can help...

So for those who also received RFE, what happened after you mailed your RFE response? Did they notify you that they already received that? Will they really process that again as soon as they get that? Or we'll have to wait again for another few months? What's the best thing to do?

Unfortunately it wont be the first or last time that someone has had to resubmit something that has gotten misplaced. If that is the case, resubmit what you have. Generally when you return what they have requested, an approval comes within a few weeks. Just double check that the dates on all your evidence is within the two years immediately prior to the date of signing the I-129F. If there is anything else you feel you can add as evidence to what you sent originally, then do so. All the best to you.

Wow, that sucks. Did you happen to make a copy of the petition you submitted? I would guess that once you get the proof back to them they will approve your petition quickly. Good luck

We got an RFE for not submitting my final divorce papers....but we did send them. So we just sent them again and were approved.

05/29/2007 - Sent package to NSC

05/31/2007 - Package received by NSC

06/01/2007 - Date on NOA (1 day after they received our package!)

06/11/2007 - NOA and Biometrics notice received via snail-mail

06/21/2007 - Biometrics taken

04/03/2008 - Transferred to CSC

05/14/2008 - Approved (notified via email)

05/21/2008 - Card received

Normally after you respond to the RFE they move very fast. My petition was approved within 2 weeks of sending the info. Good Luck

I don't think the evidence you submitted showed that you two had met in the last two years. Here is why:

-10 photos of you two together are good, but do the photos have dates? Do the photos prove in anyway when they were taken? If not, then those are meaningless.

-Copy of passport stamps. This only shows the petitioner was in country, not necessarily meeting the beneficiary.

-Copy of sales receipt. This only shows the petioner making a puchase while traveling, not meeting the beneficiary.

-Copy of credit card statements showing various purchases. Again, this only shows the petitioner making purchases, not meeting the beneficiary.

You want proof that you two were together, not items that show the travel habits of the petitioner.

First, my special thanks for those who replied here...

Yes, I put dates, our names and the places at the back of each. We followed the instructions thoroughly. My boyfriend even sent me the copy of our i-129f package. So it's very disappointing that we got the RFE.

When my boyfriend called, the lady he spoke with said, that she doesn't have our records. She couldn't even tell what our RFE is about. All she said was, "maybe it was lost...." But it's very clear in the notice that we can call them if we need more information. Ironic, isn't it?

Now, I'm thinking if it will make sense if we email the USCIS and tell them that we already submitted the proofs eversince we filed our K1. And ask them why they're asking about that now. I want to tell them that we got the RFE not because we missed something... But because they lost our papers. Has anyone here did something like this?

Edelie, I would just resubmit it regardless and send along some extra things as well. That way you are covered. If they did in fact lose it, that is irrelevant....you now have the RFE and it is best just to send/resend what they are requesting.
