Hello, I am an American citizen. I married an Australian citizen in Australia 5 years ago. I lived in Australia with him and then we got pregnant and I mived back to USA without him (loong story) and had our daughter and she is now 9 months old. We want to get back together and I want to bring him here. However last year I divorced him in an American court and there was some confusion if the state of MO had juristiction on a divorce performed in AUstralia. I got paperwork back from the court saying i was divorced though. Is there a way I can find out if we are actually divorced and if we are what is the best way to proceed? Can I bring him on a fiance visa even though we've been married once before? can his daughter sponser him?

What is the cost of bringing someone over, can someone break it down for me and tell me how much extra a fiance visa is?

Thank you so much for any replies!

If you divorced him in the US then you are legally divorced according to US laws. I can't say for sure about your ex-husband though. I would speak to an immigration attorney who knows something about Australian family law.

As far as the visa process information, check out the Guides tab above. There's excellent help there. Good luck! :)

The only thing I definitely can tell you is that no, your daughter cannot sponsor a petition. These documents need to be legally binding and she is a minor ( and therefore cannot enter into a legal agreement.)

Nothing I say is legal advice. I recommend you consult a qualified immigration attorney for any questions you may have.

Yes, even an adult daughter can't sponsor him without the waiting period.

If you are both unmarried, you can get a K1 fiance visa.
