Hi list,

My Fiance'e has received the following information from U.S. Embassy, New Delhi, India:

The Consulate General regrets it is unable to issue a visa at this time. Section 221 (g) of the U.S Immigration and Nationality Act prohibits the issuance of a visa to anyone who has failed to present the documents required in connection with their visa application, or who has otherwise failed to meet the requirements of U.S. law or regulations governing issuance of a visa. The following remarks apply in your case:

A list of all the petitioner's and beneficiary's relatives living in the US and India, with complete contact address information, telephone, and dates of birth (include cousins, aunts, uncles, brothers, sisters, parents, grandparents, grandchildren, children, nephews, and nieces, and all in-laws). For those relatives who live in the US but were not born there, describe how they came to the US, when, under what visa type, and the names they used when they immigrated. Please provide FAMILY names.

All ration cards, voter ID cards, and voter lists for the beneficiary and her parents from 1995 to present.

I have the following questions:

1. Is it better to get advice from a attorney at this point?

2. Why do they ask this kind of information?

3. What will hapeen next after submitting the above information?

4. How long will it take to get the visa after submitting the above information?

5. Do they do back ground check on each person (cousing, aunt etc)?

Please let me know.

What they request is completely ridiculous. New Delhi is really awful. Yes, contact member ManuNSam (you can send a Personal Message), they went through Delhi, were in AP too and got approved recently. Good luck! :thumbs:

Posts like these really scare me. My situation is so similar to Sam's and they were put on AP. What happens for those of us who didn't have a grandioso wedding with tons of guests? Just so hapens, my mother-i-law is throwing a village wide celebration in honor of our marriage next month in which 10 friends from here in the states will be traveling to as well. I guess we can use pictures from there for our interview once it's scheduled but I'm trying to figure out a way to circumvent any issues like the one brought up by this poster.

I have to admit that this process is really stressing me out and making me crack at the seams. It's difficult to continue to travel back and forth as much as I have and yet it's difficult to be apart. We're starting to bicker because I don't feel things are moving at the rate they should. I know this is a long journey but honestly I'm just so ready to scream it's not even funny. I guess I just need to find new inspiration from somewhere.

Yes this is a very stressful process so naturally tensions rise and due to that some arguments might come out. But one good thing is all the support we get here. Also knowledge is power so we know what to prepare for. Start now by gathering info they may request, so you have it ready just in case. :thumbs:

Hello everybody

I HAVE THE SAME SITUATION.

My wife finally went for her interview and all the documnets were found to be just fine. I want to bring this to your attention that she was questioned over and over only on one topic during the interview. And that was concerning my past relationships. She felt that it was a mental torture especially with remarks like that I don't even want to post here.

At the end of the interview, she received the following notice.

You are required to submit the following documents:A list of all the beneficiary’s and petitioner’s relatives living in US and India, with complete contact address address information, telephone and dates of birth (includes cousins, aunts, uncles, brothers, sisters, parents, grandparents, grandchildren, children, nephews, and nieces, and all in laws). For those relatives who live in the US but not born there, describe how they went to US, when, under what visa type, and the names they used when they immigrated. Please provide family names.

So my questions are as follows:

1.What if we give them the name of only our close relatives.? Would they object to the fact that we have not provided the contact info for everybody? As you might know, in Indian families, not all the relatives get along too well. Even if we tell them that we do not deal with such and such relative,would they raise any substantial doubt. Is that a good answer that we don't deal with them anymore. Some of these people have attended the wedding.( please know that our case is Genuine. It is just that a lot of our relatives are jealous with us big time)

2. What if we are unable to obtain dob from our relatives?

SOMEBODY PLEASE HELP.I AM SO LOST RIGHT NOW AND DON'T KNOW WHAT TO DO.PLEASE HELP

i wish something to be done to stop causing headaches n mental stress to both petitioner n beneficiary .

If you consult any attorney , Now in many cases where a K-1 has been delayed, refused or denied at a US Consulate, lawyers have advised clients to simply get married and file and I-130. That is not good advice, unless the attorney also advises the petitioner to pay close attention to the K-1 that has been sent back to the Service Center from the consulate.

If a Service Center begins a revocation proceeding for that K-1 petition, a petitioner’s failure to respond will mean that DHS will revoke the approval of the petition. When that happens, the 212(a)(6)©(i) that is pending in our beneficiary file, will become hard finding of Misrepresentation.
