Affidavit of Support

Hi I'm trying to figure out if there is a possibility for my fiancé to be self-supportive in the Affidavit of Support? I passed last year's tax return requirements, though I was living with him for 7 months without a job in Mexico and just currently moved back to the states. I have a part time job and looking for another. I don't think that I will be able to fit the requirements for the min. pay, though honestly I'm not sure what min pay requirement is or how much I need to have in the bank to help prove that we won't go on welfare. Does anyone know this?

Also, if I can't make these job income requirements in time my fiancé is more than capable of supporting himself. He has around $200k in the bank and co-owns a property worth $500k. In the case I can't prove I can support him, is there a form he can fill out to prove he can support himself? Any response would be extremely appreciative, thank you!

aliaushy,

Is there a form? No. Read 9 FAM 40.41 (Public Charge) Notes, N4.6-2 to find out what a visa applicant relying on pesonal resources can show to meet the public charge provisions of the law.

Yours will be an interesting situation, please do let us know how things work out. Based on what little information you've provided about your fiance's resources he may very well not need a sponsor.

Thank you for your response Yodrak :) We reviewed No. Read 9 FAM 40.41 (Public Charge) Notes, N4.6-2 and we are pretty sure we can state he can state he does not need a sponser. Though we are unsure how we would go about stating that. Do we fill out an Affidavit of Support form still for myself and get a co sponser along with additional information of his bank accounts and assets?

Check out the filing directions for the I864...it's got a section that talks about what to do if the beneficiary has assets which could be used in determining this.
