Hi,

This is my first post, if my signature shows up, you will see that the last action is that the NSC cashed my $190 check for the I-130 application, i am a little worried about reading in some of the previous posts that the NSC has failed to send out NOA1's for the recipt of the I-130, this concerns me greatly as the NOA1 from the I-130 is an integral component to my I-129F package, is there any way i can be pro-active about this and see if they actually sent it out or prompt them to send it to me with out delay ?

Also when i do recieve the NOA1 from the submission of the I-130, do i copy it and attach it with the I-129f or do i send in the original with the I-129f.

Also it looks like since it is a K-3 visa and not a K-1, i should send the I-129f to the Chicago, IL address and not any of the service centers, is this right.

Just asking a couple of extra questions because i don't want to make any mistakes with any of these forms/submission as i really want my wife to get here quickly as all of you can well understand,

by the way i am so glad to have found this site, everyone here seems to be so knowledgeble, beats wating on hold with USCIS.

Thanks in advance for your help.

I would expect to see your NOA1 in a few days, from the California Service Center. If you want to verify this now and have online access to see the back of your check, the case number beginning with WAC indicates yours was transferred to California.

Yes, you send your I-129F for K3 to Chicago PO Box.

Can i get some sort of login account with it to see my file status ?

Can i use it when i call USCIS to get status on where my NOA1 for the I-130 is at the present moment ?

Please let me know, Thanks.

Thanks for the information, i was able to register for an account and use the number from the back of my check to pull up my record of the I-130; does not give me a whole lot of information, understandable becaues the process has just started for me,

will i be able to use the same account to check on the status of my I-129f application also or do i have to register at a seperate site?

Also a question i asked before which was never answered is, the I-797 NOA1 from the I-130, do i have to send the original with the I-129F or is a copy good enough ?

Once you use your receipt # for your case it will say something like "On March xx, 2007 we received this I-130... and we mailed you a notice describing how we will process your case..." If you still haven't received your NOA1 (which CSC is notorious for not mailing it out), you will have to wait 30 days from the day they said they mailed it to you. You then call USCIS customer service and ask them to mail it out again since you need for the K-3 visa. Unfortunately, they say it will take another 30 days for this request to be processed, so by the time you DO get it 2 months will probably have passed.

I called them on 03/16/07 to get mine and I still haven't received it. That's why my husband and I decided to leave the I-130 alone and pursue the CR-1/IR-1 visa instead of the K-3, not receiving our NOA1 in time delayed the whole process already.

One last thing, you only need a copy of the NOA1 when you submit the I-129F.

A copy of the NOA1 is good enough. Being proactive on the NOA1 probably won't work but if I were you, I'd wait a few days and if you don't receive it, then go ahead and send the I-129 which will also end up in California. In your cover letter, reference the I-130 WAC number and indicate you never received the hard copy. Attach a printout of the front and back of your check for proof. The worst they can do is send it back to you. On the other hand, if they cash your I-129F check, you're good to go.
