birth certificate - foreign fiance - why?

Hello everybody,

I really do not understand why everyone sends foreign fiance's birth certificate -it doesn't say it is required?

Why would we get an RFE for sth that's not required?Or may be I am wrong?

We are getting ready to submit our petition and we really do not know whether we have to include it...

No, it is not required , but some folk here ( including myself ) send them in anyway. Should you choose to do so, make sure you have both the beneficiarys original COPY accompanied with proper translated COPY.

Why do they issue RFE's if it is not a requirement? Cos they can.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

We did not send in my birth certificate (I was the beneficiary) with our I-129F application. It was needed later at the interview stage.

We had no problems and did not get an RFE for it.

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

You might get a RFE if you don't send it in, or not. But why risk it???

If we would've known that they want it, we would've sent it...believe me. Anything to avoid a delay!!!

PS stop wondering why USCIS is doing this and doing that! It will drive you crazy and you will NEVER figure it out anyways!

I, the USC, didn't send my fiance's birth certificate. I filed through the Vermont Service Center and received no RFE.

02/05/07--Sent I129F USPS express mail

02/06/07--Application received by VSC

02/07/07--Notice Date on NOA1

02/10/07--Touched

02/15/07--NOA1 in hand (postmarked 02/09/07)

02/23/07--NOA2 (via email)

03/01/07--Date of letter received from NVC

I was just thinkin there must be something - may be they think you are not the person u say u are...or they got a hit in some of the datebases where they check your background ...

Thought there should be some logic in all this...

I was hoping we could submit our petition on Monday but now we have to wait for my birth certificate to get translated and legalized....such a long procedure...

I am sorry for your RFE but now you can count on approval soon:))))

i know it sounds stupid but try to look at it from the good side.And yes I have an idea how hrd this is cause we haven't filed yet and I am already getting crazy...

I didnt and had no problems either.

MOST of the people get no RFE for that. Because it actually isn't recuiered!!!

So that is what pisses me off sooo much.

We get a RFE for something we sent already in (proof of having met) AND for something that isn't requiered!!

How fair is that?!?!

Someone told me, that the person might have dropped the proof and is to lazy to bend down, to pick it up, so they send the RFE!

I kinda believe that!!!!

I know I would love to send them a few and demand they fix the problem within 30 days or they are out of a job . State something to the effect, " Reply within 30 days or else case closed, lights out, adios, and goodbye " .
