Tax receipts and I-864

Hi there,

we will need to order tax receipts for the past three years (which we'll need for the I-846) for my husband (sponsor) and his dad (co-sponsor). How we do go about? What's the best way to order these? Can we do it online, by mail, over the phone? If we did it by mail, what form would we need?

Also, I am a little confused about the Affidavit of Support. My husband doesn't meet the income requirements (since he's going to university and not working full time) so his dad will be our co-sponsor. They both need to fill out the I-864, right? But, does his dad also have to fill out the I-864A? It depends on whether him and his wife file jointly, right? If they file jointly, he needs to fill out the I-864A, right? If they do file jointly, still only his dad would be the co-sponsor, right?

Last but not least, here's a not so happy question: My husband's parents filed for private bankcrupty a few years back. They meet the income requirements, though. They can still co-sponsor me, right?

you can order these from the IRS on-line and they are free, but it can take 1-2 weeks or longer to get them. you can order them also from accuverify.com but you will have to pay for their service-they expedite the IRS transcripts for you and email / fax them. We got ours in 2 business days.

Thanks for your answer! I looked at www.irs.gov but I can't seem to find that online form. I can only find the form you are supposed to send in by mail. Can you help, please?

Hi I think try going on the following website and that should help you :)...I think the easiest way seems to be call them and request past tax transcripts. I believe in yr post you mean tax receipt == tax transcript..?? anyways I have put in the link below. chk it out..hope this helps.!! gluck with everything...

Requesting transcripts (individuals):

You have two easy and convenient options for getting copies of your federal tax return information--tax return transcripts and tax account transcripts--by phone or by mail.

Request transcripts by calling 1-800-829-1040, or order by mail using IRS Form 4506T (Request for Transcript of Tax Return). We do not charge a fee for transcripts. Allow two weeks for delivery.

Definitions:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income.

Neither the sponsor nor the joint sponsor's credit history is examined for the purpose of sponsorship. If they have sufficient income then that is all that is required.

Does your husband live with his father? If so then an I-864A can be used.

Based on the change in how household size is determined, sponsors may now include, in addition to their income, the income of the following persons: their spouse; their children; the intending immigrant; and any dependents claimed on the last tax return. The sponsor may also include the income of any "relative" included in the household size determination.

In order to count their income, the sponsor's parent, sibling, or child/son/daughter must currently be residing with the sponsor. The sponsor's spouse must also be residing with the sponsor, unless the spouse is an intending immigrant. However, none of these household members need to have been residing with the sponsor for the last six months. It is enough if their principal residence is currently the same as the sponsor's.

In order to count the income of any of these household members, the person must be at least 18 years old and, except for the intending immigrant, execute a Form I-864A, Contract Between Sponsor and Household Member. If the household member is not the intending immigrant but is the sponsor's parent, sibling or son/daughter (other than a claimed dependent), he or she must submit proof of that relationship and current residence with the sponsor. The sponsor's spouse and claimed dependents do not need to submit proof of residence or relationship.

These household members do not have to be U.S. citizens, nationals, or LPRs. Nor is there any specific requirement that they be residing in the U.S. with lawful immigration status, even though USCIS may impose such a requirement. The I-864A only requires that the household member provide a Social Security number if he or she has one. They must, however, provide the prior year's tax return.

If your husband's father does not reside with him then "dad " would fill out the I-864 following the instructions as a joint sponsor.

I think I understood that, but please clarify.. My husband doesn't live with his parents. So both my husband and his dad fill out the I-864. Does anything else have to be filled out since his parents are filing jointly? I don't understand how that works.. Will the income of both mom and dad be combined if they file jointly?

Yes they both ( hubby and dad ) fill out the I-864.

If the same rules apply to joint sponsors then.......

If the income of both parents is used then, dad fills the I-864 as the joint sponsor and mom fills the I-864A (in correlation to dad's I-864)agreeing to have her income used to as support. Its not a requirement to use both just because they file taxes jointly. The tax return will show the separation of income.He will report only his income on the I-864 line 23 and 24a. If mom's is used it would be reported on line 24b and totaled together on 24c ( otherwise only dad's income will be listed for the 3rd time on 24c).

I agree with CutienPurg.

I also wanted to mention that you do not need to order tax transcripts if the sponsors have copies of last years tax returns (as most people do). A photocopy of a tax return is totally acceptable.

Also, only one year is necessary, not three. The additional two are optional.

By the time your case reaches NVC your husband and father-in-law will likely have filed their taxes already, so if they don't have copies of last year's return, they can just make a copy of this years and that should be all you need.
