What are my options?

Hi Jeremy and Kristy,

Good luck on your immigration journey. From personal experience, arriving in the USA on a visitor's visa from Canada, getting married, and then applying for an AOS is legal to do. This is provided if they DID NOT come into the USA with the intention of immigration fraud by getting married here in the USA. The AOS this way worked for me (as I got my AOS approved/Green Card), but I can't say that it will work for everyone else, as every situation is different. My best advice to your and to anyone else who want to go through this route: Get your story straight, your paperwork organized and hire a good immigration lawyer.

My fiancé, Kristy, lives 15 minutes away from me, as I live right on the border. My conundrum is this: I don't think we have time to file for a K-1 as the wedding is scheduled for September 1st, 2007. I'd like her and her daughter to live with me after some point this summer, before we get married. The honeymoon is booked for the US, too.

What exactly would you guys think my options are? Being a visa waiver country are there things I'm overlooking? Am I fretting too much? Should I just file for the K-1 ASAP and cross my fingers that it will be done in time?

I would imagine that, unless she has a specific social work degree, she could not do "Social Worker".

Well, the TN-list doesn't exactly specify that a SW degree/diploma is needed. No contest that "tweaking" daycare instructors job to Social Worker to USCIS satisfaction (with the additional headache of correct-format offer letter) would cause some serious migraines.

(as you can guess, the idea was to see if her entering as a TN-1 with her daughter as a TD--but best to see the options explicitly ruled-out than to never have been aware of them)

Ant, with all respect, I think you need to be careful when giving your situation as advice to someone else. This man already has plans of getting married and the family immigrating to the US. How can you suggest that their situation would *not* be doing exactly what you say does not work? er, that wasn't worded very well, but your closing advice makes it sound even sketchier.. 'get your story straight'?.

Just to be clear: you must not enter the US as a non-immigrant (visitor) with the intent to immigrate.
